Considering bankruptcy - I'm at rock bottom

    Its an awful position to be in, but I think once you get past that barrier that BKY is the right thing then you can storm ahead and eal with it...

    Hey bluezone... You havent posted on me new thread... we have decided to take the BKY plunge and your advice would be great !

  • £30-£35 per month for telephone (mobile and landline) would be ok. But unlikely £35 for mobile only plus £X for landline, but depends on the examiner and your explanation of why it is necessary.
    And yes you can be asked to cancel the contract, as any money owed under the contract including termination charges woudl become a debt in the bankruptcy. same for sky tv, which is not considered essential.

    Hi, i really feel for you but at least you've got the drive to sort it all out now. Wish i hadnt left mine till now but at least i've started.

    Can i ask if you go bankrupt and you have an overdraft in your current account what happens? do you need to switch which account you get your wages paid into?

  • botom line is yes, as account is overdrawn it will be a bankruptcy debt, account should be frozen by the bank so you shoudl open up a new basic account

    I was also told with bankruptcy you still make payments for a year before they wipe the outstanding amounts out. Thats what CAB told me.
  • One question I had, which I hope somebody can answer - is what sort of view the OR normally has on the possession and use of a mobile phone. I think pretty much everybody has one these days don't they - yes we use them to text and chat to our family & friends - but also as a young female out and about on the streets on my own and also in my car on my own - I consider it invaluable. A little while ago I renewed my contract with my provider and I am tied to it for 18 months. I pay a flat monthly rate of about £32 (or I think £35, not sure without checking) - and this gives me quite a large allowance for calls or texts. Since being on this plan, I've found I don't really use the home phone! My bills have never gone over this monthly standard charge & I can't anticipate the need for me to. Would the OR consider that is an 'uneccessary expense'?? Also if I am tied into the contract, surely they can't make me cancel it??

    Hi, GL. The OR accepts a phone as a necessary expense. Your problem will be wit your contract. Under bankruptcy rules, you can't have credit of more than £500 until discharge. This usually puts a spanner in contracts where you use in advance of payment. This can also be a problem with direct debit payment for utilities.

    Another small point is that the cost is £485, not £475 as stated here. I'd check this with the court though, as costs increase from time to time.

    As regards timing, in our area, it can be between 1 day and 4 weeks' wait. You can always ring the court every day - it's surprising how often they geta cancelation.

    Unable to offer specific advice about the situation you're in, I just send out positive vibes of encouragement that you WILL get through this. I have every confidence that with your obvious intelligence and the many fabulous and informed people on this site, you'll find the best route forward.

    What this man has done to you is loathsome (and criminal). If there is such a thing as Karma, then I hope a heap of it lands on him. Conversely, you showed great support to someone you loved and your outrageous abuse, I hope will be corrected by what ever force for good is in the universe.

    Just reading your thread for first time. You have had some excellent advice and are acting on it. I wonder how many of us, myself included, should be following your example.

    Thanks very much for your replies.

    Well a little update so far. Have been getting myself into such a state over all this, the stress and strain and worry has manifested itself in my health, as I feared it would. Normally I'm such a fit and healthy person and am priviliged to enjoy excellent health at all times. The last couple of weeks have seen me suffer from a variety of ailments - continuous headaches, sickness, stomach upsets and disturbed sleep. It has been almost impossible for me to function at work as I can't concentrate as so tired from lack of sleep, I have constant stomach pains and headaches & keep sneaking off to the toilets to cry. I feel so depressed all the time.

    I took the advice from my mother and went to see the Doctor this week. I told him all about my problems and the variety of ailments I was experiencing. He was excellent - very sympathetic and listened to me without hurrying me. He said I am obviously very stressed and depressed and my physical symptoms are as a result of the stress. So - he has given me some medication in order to lift my mood somewhat and also to help me sleep. He has also suggested it it not a good idea for me to be in work at the moment so he's signed me off sick for a week. That's a big relief for me, because I was really struggling to hold myself together at work.

    Isn't it amazing how stress can affect one's health? Quite frightening really. I'm the annoying person who never gets sick - I rarely get colds, stomach upsets or anything. Yet the build up of worry and stress has become like a poison in my body and that poison has to come out somewhere - in my case, headaches and stomach problems. You can easily understand how stress kills. I'm young, fit and healthy - in me, the symptoms are mild. In people less robust - well you can imagine the consequences.

    Manage your stress folks!

    Anyway on with the show. I have started to fill out the bankruptcy forms online, I've done well over half so far. Phew there's so much information to gather and find! I felt too ill yesterdy to complete them, but I slept well last night and have woken up refreshed and raring to go. I WILL complete the form by today and have it winging its way tomorrow.

    My other goal is to prepare letters for each of my creditors. The phone calls I am getting are now becoming a nuisance and harrassment. I would say there's at least 8 or 10 a day. I just ignore them. My dad is getting a bit fed up with them as his eyesight is a bit dodgy and he can't always see the caller ID!

    Can anyone help me with what I should put in the letters? I basically want to say that I am having a financial crisis and am filing for bankruptcy. Please do not contact me by telephone in any way whatsoever (is there some sort of law or Act I can quote here?), but if they feel they need to communicate with me then it must be by post only. Then I guess I could say the next communication they will receive will be from the OR!

    Please help, I'm really not sure how to word it in order to stop them ringing and sending me harrasing letters. It's the phonecalls which start my stomach cramps up again.
