Wrong item sent

My friend recently bought something from ebay, it wasn't anything expensive so its nothing hugely major, but when the parcel arrived recorded delivary, what he got was something a lot cheaper and not the item advertised.

What proof can we now give that the item we recieved was not the one the seller said he posted, because I think it will be his word against ours, if we file a complaint with paypal, who will win it?

    First step: contact the seller. Explain the issue politely.

    If no joy there, file a dispute with paypal for item not as described. Hard to predict which way they will decide - depends on the item.

    If it is significantly not as described contact the seller and see what they say - it may just be that he has sent the wrong item by mistake. If you can make nothing out with the seller file a dispute with paypal - it wont cost you though you will probably have to send the item back for a refund - paying the return postage charges hence the best way is to try and work something out with the seller first

    I got lucky when I had to do a not as described dispute.

    It was a jewellery box, 'RRP £60'. When it arrived it was cheap and tacky, poorly made, and not even leather as stated!

    It's possible that the seller didn't bother responding to the dispute... because paypal got me a full refund and didn't even make me send it back. (I would have done, but he never replied to my requests for his address details)

    Guess if he was as uncommunicative with them as he had been for me, paypal wrote him off as a waste of effort!

    Your post would indicate that you haven't contacted the seller yet, as Fay suggests a polite friendly e-mail to the seller is the first course of action. If you have no joy send it back to them immediately and file a PayPal claim, I wouldn't warn them its coming back they might refuse delivery.

  • If he is disputing it what about sending him a photo of the offending item for him to compare with the photo in the listing pointing out the differences.

    Sorry I forgot to make it clear that the seller has so far been uncontactable, I think we will have to file a paypal dispute, but I have nothing to prove it, all it is, is his word against mine

    Ive just had a problem with wrong cd being sent to. It should have been "on a dance tip 95" (1995), a double cd. I was sent "on a dance tip" a single cd-a totally different album. The listing had full track listing which doesn't match what was sent.
    A friend who uses ebay regularly advised me to contact seller (which I did and waited over 4 days for a reply). I thought it may be a genuine mistake as they are similiar cd titles. The seller did reply but really didnt seem to care, they tried to state that according to his records on paypal and ebay I got what I ordered-I checked mine and the listing again and this is not true so I sent a reply to them that I have checked my records and will therefore be opening a paypal dispute. I have opened the dispute on advice from my friend.
    The guy also got a negative the other day for sending the wrong cd and not replying to emails-only offered refund when negative feedback was left. I have not left any feedback yet although they left me a positive! And this negative feedback also notes that the phone number they have given on ebay is a fake! Grrr.
    So my advice, check other feedback, if the guy doesnt reply to other means of contact then open a dispute.
    Out of my mind. Back in 5 minutes.
