i was paid income support ,but should not have claimed for, and have to pay back at £15 per week out of my ib benefit,
when the department works out my disposable income my dla is included
in this amount [higher mob and low care]
is dla normally included when working out what you can afford to repay

Dont know the answer but if you can afford to pay the £15 it will be paid back that much sooner and you will be debt free quicker.make the most of it, we are only here for the weekend.

DLA is income so I dont see why they wouldnt count it as such.0

I would appeal their decision. When we were asked (polite way of saying threatened) to pay back an overpayment of WTC (which we didn't actually owe in the end but that's another story) the DWP ignored my husband's DLA completely.
In their own words the mobility part may have already been used for a car and as for the care element that is meant for the care of the disabled person. I do actually pay towards a carer with my husband's DLA so we get a break from one another.

Hi Sorry I got that wrong it was the tax credit people who wanted the money back not the DWP always confuse the two.
We didn't have to pay it back in the end though as it wasn't an overpayment anyway, (they wanted us to repay the WTC we'd had whilst hubby was on SSP for six months but you are allowed to keep them for that long).
My reply to the OP still stands though as DLA really shouldn't be classed as income because the money is specifically for the extra costs associated with disability, without ours my hubby wouldn't be able to leave the house.0
