Last weekend I bought a shirt and a pair of shoes for my boyfriend from Burton online for a wedding that we were attending this weekend. I paid extra for express delivery. I got in from work on the Tuesday, and there was no card through the door so assumed they hadn't tried to deliver the item. I then received an e-mail saying that they had delivered and that it had been left in my outside toilet. I do have an outside toilet around the back of my house, but my gate is bolted from the back so no-one would be able to get in. I then phoned Burton to tell them what had happened, and the woman I spoke to told me it had been left in my garage. I do not own a garage. She then said it needed looking into and if it hadn't been delievered correctly I would get a full refund, including the cost of delivery. I have received an e-mail today stating that the courier says that the driver delivered it correctly so they won't be refunding me at all. Surely they cannot do this......I have never received the items and they would have no proof of delivery as I hadn't signed for anything and nothing was left through my door. Obviously then we were without a shirt and shoes for the wedding so had to go out shopping after work one evening last week to buy. Does anyone know what my rights are here? Thank you.

Have you actually looked in the toilet?
Your contract is with Burtons, not the couriers, call Burtons up and say you have not recieved the delivery and would like a POD of YOUR signature, if they cannot prove you have had the products then ask for a refundAlways ask ACAS0 -
I have looked in the toilet twice!! It's definately not there. It was Burton I contacted, and they contacted the courier. I will be ringing them tomorrow when the lines are open, but just wanted to have a better idea of what my rights are before I phone them.:j:j Getting married 28th July 2012 :j:j0

Ask them for a Proof of Delivery and your signature and when they cannot prove that ask for a refund or for the items to be resentAlways ask ACAS0
