    Thanks Uncertain. I have just emailed the trainee solicitor my response to my former employees tribunal submission, as she has requested. I have then asked her if she can confirm whether I will be represented by a fully qualified solicitor on the day and not just a paralegal. If she responds saying it is not a fully qualified solicitor, then I will write the letter as you suggest. I will be moving my insurance after this too. Whats the point in having a policy and shelling out all the cash, if the insurance are cutting corners. :mad: The whole thing has been stressful enough as it is, without being frustrated further when talking to individuals who do not know what is right from wrong. Arghhhhh

    I completely understand Boopoops - and sympathise. And I agree with Uncertain about getting things in writing. But some words of caution. Your current rep may be crap (or I would advise politer words to that effect), but be cautious about demands - as the Chinese curse says, you may get what you want. I have four paralegals who work for me on a permanant basis. They frequently do tribunals (under my supervision). I would stake any of them against a solicitor in 80% of the cases we deal with (and I deal with the others - not them!). Being a paralegal does not mean they are not better than a lawyer for something like this. Softly softly often catches monkey - and complaints against solictors seldom get anywhere, so catching the monkey is a good idea.

    I suggest you try to work what the other side's costs are likely to be if it goes the distance, less what they have spent so far. Your solicitor must be able to offer an educated guess. Then halve this.

    This is the very least it will cost them, even if they win.

    Also ask your solicitor for a pessimistic idea of what you might be awarded if you win. Sadly this is likely to be a good deal less that you might hope! Again, halve this.

    They may well grudgingly settle at around the two half figures above added together.

    If they do settle they will no doubt be looking for a confidentiality agreement as part of the deal. If that is likely to be of real importance to them this may help to push the figure up a bit.

    Also, you may be able to get them to provide an agreed reference as part of the settlement. Is that important to you? If so, factor it in.

    Surprise surprise. My employer has postponed the hearing as their legal rep had another tribunal for that day. They have listed all the dates they say they cannot attend, and it leads hardley any for this year. My solicitor recons it will be the end of the year if not next now.

    We have not received no response to the offer we require. We were supposed to swop bundles last Friday. My solicitor sent ours, however my ex-employer have failed to comply. When requesting it, the legal rep is saying he is in court all this week and then on holiday for 2 weeks so it will take time. I am so annoyed. My solicitor has told them we must have it by this Friday as she will report it as non compliance. She says they are being awkward and dragging their feet and she expects it will continue for sometime. They recon they will send the bundle Friday minus witness statements which will be sent at a later date. Can they do this?

    I've struggled to concentrate all week due to their mind games and it is affecting my performance in my new job. I just feel that its all going to end in disaster. Its getting to the point I do not feel I can deal with it anymore.
