Dismissed on sick leave due to false allegations

    Thanks XbrenX. The book is yet to end though. I know I still have a massive uphill battle to win in order to see an end to this. My employers will not shy away easily. The three managers involved in my dismissal have done this to many others in the short time I was there, but I do not think that any of the victims pursued it as far as tribunal. These managers will be shaking in their boots, now that they know I have pursued it legally, as they thought it was empty threats. They will have to ensure that they win this tribunal, otherwise the top will ensure they are next on the chopping block!!! I know they were all interviewed and questioned following my appeal, so they did feel a little of what it was like to be me, howevr they stuck together with their fabricated web of lies. I know there will be new incriminating evidence that will magic its way into existance, but I will not give up. I pray I win this fight and that what goes around, comes around, where those horrible individuals are concerned.

    I have received my Tribunal date scheduled for 3rd of September. Did not expect it this soon. As suspected my employers are denying all their wrong doings, they have even said they delayed the hearing for me on 2 occassions but they did not, they only did it once. Anyone who has been involved in a tribunal, do I have to highlight these lies during the tribunal or is it best I write stating my disagreement?

    My tribunal date is set for the 3rd of September. I am progressing this via my legal expenses insurance. The individual dealing with my case I have discovered is not a solicitor, but a paralegal I think. She went away on holiday for a month and has been off sick for at least another 6 weeks since. I am now being dealt with by a trainee solicitor. I do not feel confident in these people to help me to be honest. I live in Brum area and the insurance have given me solicitors in Cardiff, so I can hardley visit them and voice my concerns. Numerous errors were made in my ET3 despite all information being supplied to them. I do not know what to do. I had a brilliant solicitor nearby who was giving me free advice over the phone and was going to help me in my case to tribunal, but the insurance would not cover all the cost unless I went with them, they said the money would run out and I would end up paying towards the costs which I could not afford. I am worried I will lose with these fools. I am now in new employment I love. My boss is fantastic and so are the other guys around me. My new boss knows about this trouble I am experiencing and she is great, but I do not want to lose this case in case people start to doubt me. I am innocent and I want this proven, however I know my ex-employer will try to dish me in anway possible. I need a team committed to my cause and this firm are not when I have not even got a proper solicitor supporting me. What can I do?

    I am afraid there isn't really anything you can do. The pro-bono board will not take a referral because you already have legal advice which is paid for. It is a problem in insurance cases - many of the people you speak to or who deal with you are paralegals, and whilst many of them are very good (and all are supervised - or should be - by a qualified lawyer) there isn't much that you can do except complain. I do hope that it turns out as you wish, but I siencerly doubt that whatever the outcome, your current employers will think any less of you. You have been honest and upfront, so they knew the person and circumstances they were taking on. And since then they have got to know your work too. Tribunals are always risky and everyone knows that. I doubt at this stage they would change their opinion of you because of something like a loss. Get the tribunal out of the way, and whatver happens, just get on with your life.

    When MrsP took her unfair dismissal to tribunal, she too was also provided a solicitor by the insurance company.

    What was very strange was that this solicitor was from Bromley in Kent - we live in the North East of England.

    On discussing the practicalities of this, we were told that on the day of the tribunal, the solicitor would travel up from Kent.

    That was a complete waste of time and money IMO - even though this was being financed by the insurance company - but then again, it would actually be ultimately paid for by policy holders.

    I asked (as I was the policy holder) if it could be possible to nominate a local solicitor who specialises in employment law and they actualy agreed to this provided they met the needs of the insurers terms and conditions - which they did.

    Although I had done all of the groundwork, they were excellent and provided regular communication on the progress of the claim.

    The claim was remedied one week prior to the tribunal hearing.

    The problem is I have not been supplied a proper solicitor, mine is a paralegal, who is now sick and they have since supplied me with a trainee. I have asked some quite simple questions as I see for a proffesional and they keep saying they will get back to me, need to check!!!

    Mine will go all the way, I know these people who employed me too well. So many people have pursued this company to tribunal, I do not understand how someone does not pick up on this fact at the tribunal service.

    Have you complained to the senior partner in the solicitor's firm, with a copy to the insurance company detailing EXACTLY the problems and poor service you are experiencing? If the firm do a lot of insurance work they will not want their shortcomings paraded in front of the insurance company.

    Keep a detailed log of all communications with the solicitors. Did you not get a letter from them initially detailing who would be conducting your case, who was supervising them etc?

    Ultimately, you and not your insurance company are their client even though the insurance company have agreed to pay their bill.

    The letter to the senior partner is a good idea, I would definately do that!
