abbey/santander charges

back in 2007 i started the bank charge reclaim process with abbey and ended up getting put on hold by court.

since then i have waited events like everyone else,but about 6 weeks ago i wrote to abbey/santander explaining that when all the problems started it was mainly due to a few incidents of going slightly overdrawn and getting hammered for £35 a pop only for this to snowball month on month and ending up getting charges on charges until suce time it was very difficult to cover the cost of everyday items i requested a refund of charges(at a reduced amount compared to original claim).I have had a letter back rejecting my claim.
So can i try to claim refund of charges on hardship grounds as i have tried? (not in hardship now but i was when i incurred all charges)
I did email them a response as the letter had an email address on but heard nothing back,should i post another letter or try the FOS route?
any advice is appreciated

    What hardship did you suffer? Was there priority debts at the time(mortgage/rent, council tax, utilities)?
    What did the bank say when you first approached them?
    As an aside, what are the terms of the stay that you have with the court?

    at the time when i was getting the charges it all just snowballed i.e i got charges and then not enough money to cover bills so D/D's were rejected causing more charges.it ended up that i could just about cover mortgage and basic bills the rest of wages went on bank charges.

    the bansk response to my recent letter was to tell me they do not need to repay as charges are fair and referred to test case they gave me some debt counseller numbers.

    claim is stayed like a lot of others because of the test case as i originally did not go down the hardship route.

    I need you to be more clearer. The question I asked was WHAT DID THE BANK DO AT THE TIME THE CHARGES SNOWBALLED?(apologies for capital lettes but I don't care about the recent response but their response at that time and potentially since).

    If the claim is stayed then you NEED to know the terms of that stay because if the case is already struck out then it might not allow you any route. I don't think you did enough at the time btw because simply saying that the case was stayed is a lame excuse. Martin's email update and media reports on bank charges did mention financial hardship. Apologies if this sounds harsh but it needed to be said.
