After Ten Years

I don’t know whether I’ve posted this in the correct forum but hopefully someone will advise.

I’ll try and keep this brief. I’m looking for advice on my situation.
In 1999 life was ticking along nicely, until the end of April when I had an accident at work.

At the time I had four credit cards and my wife had a personal Bank loan which had been running for three months. This loan did not come with any payment protection due to my wife not earning enough in her part-time job. I was earning very good money at the time and payment were never a problem.

So after five weeks in hospital, I returned home and requested the claim forms for my credit cards, which I filled in and sent off.

Within ten days all had replied with the same outcome. These companies, who had received payments every month without fail, claimed that I was not entitled to any payment protection because I had not been with the works where I had the accident for twelve months. The accident happened six weeks into my employment and yes, there in the small print was this clause.

It took me three years and two operations to get back to full-time work. By which time the company had made me redundant just short of two years. I had returned but due to pain and physiotherapy my hours worked was greatly reduced.
My compensation for my injuries arrived after five years just in time to save our house and our mental states. However, the compensation didn’t cover all the debts which had arisen over the years.

Today I have paid off most of these debts. However my wife’s personal loan and one credit card still remain. These were added together several years ago by the Bank. We had the interest on this frozen thanks to the CAB.

So my questions are after all these years, is there any chance of challenging two decisions made ten years ago? And if so, how to go about it?
1) That I had paid PPI on my credit card and was not verbally told all the facts.

2) My wife was offered a Bank Loan which she could not repay if circumstances changed. Knowing full well she was not entitled to any insurance.

  • On question 2 your wife has no case since she was not forced to sign the paperwork. On question 1 I would ask in the PPI forum due to the length of time you have looked at pursuing the PPI.
