i have been on hold for 2 years help

hello i tried to calim back charges in 2007, i got the list of charges and sent the relevant letter to the bank, they replied in 2008 stating about the ongoing court case beyween the bank and somthing to do with the obundisman service bla blah, anyway i have had no further contact from them what so ever although the letter says may case is still on file and they are sorry i am unhappy, i am not sure what route to take now as some of the charges i am claiming for are 2 years over the 6 year mark now i need some advice, its definatly hardship as i was on benefits and getting charges for charges and sometimes charges for pennies over my limit one occasion cost me £60 for about 36p what a joke, i need my money now...pretty please:cry: i have been so patient almost to the point of letting them rip me off for good:mad:

    If it's definitely hardship, why have you not been in contact with the bank for 2 years? Banks' have always dealt with hardship cases which DOES NOT always lead to a refund of bank charges.

    well i havnt been in contact about it because the letter stated that my case was on hold and they would be in contact with me as i say i have been patient maybee overly so, do you think i should speak to somone in brach or write a letter to them, im really not sure what i should do??

    Have you been a member of any reclaim site at all since you went through the reclaiming site since your join date here suggests you haven't been here?

    hello again no i havn't been a member of any site i just got hold of a template letter downlaod way back, i just found this site by chance when looking to save some money,
    my financial hardship first started when i quit a job, which meant there would be a 2 and a half week period before i received any sort of benefit..jobseekers, which meant i could not pay for day to day living and had to max both my accounts, then i received a tv liscence direct debit which bounced causing charges from the bank and then the same happened with a bt direct debit but if i remeber rightly bt also charged thier own charge of £20 aswell, my wife then ended up having to go on income support for personal reasons and the jobcentre then requested she take a medical which she did and they then decided she wasnt elligable for the income support, we appealed against this but as a result there was a large gap where we didnt receive any income this also happened again about 6 months later, this was a very stressful and upsetting time for the both of us. we were having to apply for crisis loans to get by but in the mean time we were receiving charges from the bank for unpaid charges, this went on for a fair length of time, eventualyy they agreed to give me an over draft to clear the cycle. this helped eventually and when we finally got the income support which was back dated was able to pay the debts of and get in the clear, but obviously we were a fair amount out of pocket, thats when i decided to send the letter after getting the list of charges which i paid for, which brings me back to my original post.
    iv tried to forget how crap things were back then, maybee i will feel better when i see somthing back for it hey:think:

    I think the statement in bold actually means that the bank did do something at the time. As the arrears are cleared then I think Financial hardship is not something that will lead to a refund of charges on that basis.
    I think you are going to have to read the guide and look at the legal arguments and fully understand them. I don't think the bank will see this as a failure to deal with someone in financial hardship.

  • i see your point, i think i dont want to be going down the legal road too much stress in my life at the minute, the other thing is although i cleared the arreaers i have never been able to get rid of the overdrafts, i just increase them from time to time which covers me from going overdrawn and getting big charges but i do get charges for having used the overdraft each month on both accounts, there is no-way i will be able to clear these now on the income i am on would be eaten up,

    Are there any credit card charges/catalogue charges/ store card charges to reclaim?
    Have you looked at council tax rebanding?
    Any PPI?

    There are a load of things on MSE you can look at, even debt free wannabe forums(I am a secret one of them but no threads on that part of the forum ;) ).
