Tesco Diets website - non-refundable?

I signed up to the tesco diets website, paid £29.90 and spent a bit of time trying to work out the diets they stated and how I could best use them. I used the site for an hour, found it too time consuming and so asked for refund and cancel membership. They've refused on the 3 times I have emailed them, stating they are not using the distance selling act as the service is made to me immediately. I admit I did not check t&c's, as I've shopped on the internet before and always had some cooling off time.

Tesco are adamant I am not getting my money back. I really don't want this service and have not been back to the site since - is there nothing I can do about this? I have looked at a couple of consumer websites and only found information regarding how you are covered by the distance selling act.

  • No there's nothing much you can do. DSR contains specific exclusions for instances where you pay for a service and immediately access it. This includes websites such as this one. Having spent an hour using the website you have already accessed and used the service so you have no right to a refund having decided that it's not for you.

    I would have thought Tesco wouldn't run a "dodgy" business like this.. it's only good customer services to have at least a 24 hour test run but if they don't offer it then you don't have any legal right to cancel I don't believe.

    I've used this site before. They do offer a 24 hour free trial, I used this and decided it wasn't for me.

    In what way is it 'dodgy'?

    Yeah I'm a bit confused by this as well, if you have already gone in and used the service but just didn't like it then why would you be entitled to get money back?

    It only takes a bit of time once a week to select your meals - once you get used to it it's quite good.
