AfC and public holiday pay

Hi folks!
We work under Agenda for Change Terms.
Staff are being asked to work public holidays i.e Easter Friday.
management are saying they will be paid Time +60% .As far as I can see this is the overtime rate and not the PH rate, which would be double time.
Staff normally work 36 hrs Mon-Fri.
Any help would be welcome:beer:

Looks like it is been done as BH rates not overtime which would be correct since it is not overtime.

You should stll get the holiday in your allowance to take at another time.

CORRECTION:

which band are you in.

I think it depends on which band you are on, domestic staff (band 1) will get double time for bank holidays but this changes on first april. as far as i know its like time and 40(odd)% for saturdays and time and 90(odd)% for sundays. futher up the band scale you go less it gets.

Im band 2 and get time and 60% for public holidays and weekends but I get something different for overtime - its rare we full timers are allowed overtime because it costs them too much

I would look into that that link says 88% for band 2.
Sat is different to Sun/BH

Is it overtime or normal rostered shift that falls on a BH. The 2 have different premium rates, OT being higher

Oh Jings I am even more confused now.:o
Agenda for change handbook 2010 says ""All staff in pay bands 1 to 7 will be eligible for overtime payments. There is a single harmonised rate of time-and–a-half for all overtime, with the exception of work on general public holidays, which will be paid at double time."

Is this not the case?
How come it has changed?
We are AHPs and band 3's and band 6's
Our dept is only open Mon -Fri and normally shut on PH's.Due to pressure to reduce waiting times we were asked to work but for time and 60%.

So much for AfC harmonising terms and conditions:mad::mad::mad:

The 60% is the enhancment if you normally work a roster pattern that means working on a bank holiday
Double time is the overtime rate.
As you are a 9-5 Mon-Fri type person you should be getting overtime.

Your employee is either:
1. Trying to save money/rip you off or
2. Has just made a mistake

I think this would normaly taken off by using a days holiday

So if you work it is at bank holiday pay not overtime and you don't use a days holiday.

Just got this response from my union.
It seems a rather mean way of working and certainly not the way it used to be under Whitley.

Payment for working on a Public Holiday depends on banding of your post and whether the work was carried out within 37.5 hours or in addition to 37.5 hours.

If you are asked to work a Public Holiday and those hours would be worked within your standard working hours e.g. working Easter Monday and the rest of that week (Tuesday-Friday) you would be paid unsocial hours rate for the work you carried out on Easter Monday i.e.

Band 1 double time
Band 2 time plus 88%
Band 3 time plus 74%
Band 4-9 time plus 60%

(A4C Ts&Cs Handbook Para 2.13)

Also, staff who are asked to work or be on call on a Public Holiday are entitled to equivalent time off as well as the appropriate payment. This means that if you work on e.g. Easter Monday you should get a day in lieu as well as unsocial hours rate at time plus 60%

(A4C Ts&Cs Handbook (Para 13.4)

The reference to double time for working a Public Holiday is confined to circumstances when working a Public Holiday as overtime e.g. if you were working on a shift pattern which started on Monday morning and you worked four shifts over Monday to Thursday which took you to 37.5 hours – if you then volunteered to work on Good Friday then that shift would be paid at double time because it is overtime
