Fraud by debit card, will the bank reimburse me?

My situation is this, last Thursday my debit card was stolen, I became aware of this around 12 hours later and contacted the bank to report it stolen and cancel the debit card. The card had been used after I cancelled the card but I am not worried about this as I will be reimbursed by the bank for any fraudulent use after I reported it as stolen.

But within a few hours of my card being stolen it was used to withdraw £200 from an ATM, this happened before I had reported it stolen. I assume the thieves saw me entering my PIN and then pick pocketed me. Will the bank reimburse me for the £200? I have no criminal, never had a bad debt and I have a good credit record, if that makes a difference.

    This is a difficult onw as they used your pin. Most banks would probably try and argue that you have a responsibility for keeping your pin safe. The fact that you have no criminal record or previous bad debts will be irrelevent.

    Hi,

    Best thing to do is look online at your banks website and find a number to ring about fraud and ask them. I don't see why you couldn't claim it back, although for future reference you should cancel your card asap! Just call them and explain everything and see what they say.

    My bank account was used fraudulently a while back, but this was with account details online, i made a claim and got my money back. It's worth a go, you don't want to lose that much money! Good luck and let us know how you get on xx

    ETA: Mine was used online a few times but i didn't notice and this was before the card was cancelled, i know it's a different situation, but it shouldn't matter.... if you didn't use it, you should be entitled to your money back. They should also investigate it, they can trace when and where it was used etc!

    The card was reported stolen and cancelled but this was 12 hours after it was stolen.

    A friend has told me even though the £200 was withdrawn before I reported the card stolen I will still be reimbursed as I reported it stolen within a reasonable time. I hope this is correct.

    Do all ATM have CCTV? This would prove I did not withdraw the cash.

    I'm trying to get as much information about my rights before I phone the bank tomorrow morning about the £200.

    I will keep you posted.

    How did someone see you entering your pin number?

    That is not possible if you were taking suitable precautions is it?

    Can you see how the bank might, just might, get the wrong idea about where the £200 went?

    Don't get me wrong... obviously I have no idea what happened.... just trying to balance against an earlier post which said something like "if you didn't use it, you should be entitled to your money back"... and that of course is correct too.

  • No offence taken KeithP, what you said is what I'm afraid of, will the bank believe me.

    If someone/someones goal is to see a PIN being entered I think this is easily achievable, cameras, mobile phones, in a busy place etc.

    I'm not quite sure what your legally entitlement to with debit cards is but its very difficult to fully cover your pin. I wouldn't worry too much about proving your took reasonable precautions as long as you didn't have the pin in your wallet/on phone/muttering it too yourself you'll be fine. My ex used to carry her pin in her purse I made her take it out a few months later she lost said purse. If her pin was still in there she would have been fubared.
