PPI claims and deadlines. What next?

Hi,
I have been mis-sold PPI (PPC as it is on my paperwork) and have been in touch with Abbey. They told me to forward paperwork to prove that I was a full-time student in that year. This was in October and they were to write to me with details. I waited and nothing arrived. Eventually I rang them and they said they had posted the letter to me. I assume Royal Mail lost it and so they said they would send a new copy. It arrived just before christmas. As it was the Uni holidays there was no way I could get the paper work and so the "8 weeks deadline" they had written to me about had passed by the time I sent in my letter from the University.

Now I rang Abbey thinking that they were just being a bit slow, but they have said that because I did not get the form in within 8 weeks that the case is now closed (!?) never mind the fact that I did not get the letter in October (as it was dated) I did have the paperwork with them 8 weeks from the new letter date.

What do I do now? The thing is, I have 99.9% surely been mis-sold PPI. Can they really put a deadline on it like that? Where do I take this next? I was a full-time student with a temporary job at the time I applied for the card. The PPI was on an online form that I had filled in and when my bills came in I was a CC virgin and had no idea what it was so I kept paying it like a dimwit.

Any advise welcome.

It is likely that they have used a two stage complaint procedure but if they are not re-opening the case it is possible that they have deemed themselves to have issued a final response in October.

That would mean you had six months from then to get a complaint to FOS. That means your time will run out in April, which starts in less than six hours. Telephone FOS tomorrow and also get the form off their website, complete and post it tomorrow.
  • The thing is, if I did not receive their October letter (end of October so hopefully i have a few days leeway) and only received that in December isn't it a bit unfair that they are counting October as the deadline.

Royal Mail absolutely do my head in. This isnt the first time I haven't received letters from them.

Am sure it will be fine even if it was their last response if you did not receive it then how would you know. That is why I am saying contact FOS I had a similar problem with one of mine and it was over the six month limit but the FOS still looked at the complaint and upheld it. Do not panic just ring them.;)

  • Thanks to everyone. I will be getting on to it today. I have not got much work at the moment and it was only through listening to Martin on GMTV a while back that I realised that I was paying PPI. Having gone over my accounts it would appear that I am looking at £5000 worth of PPI. I owned my own business and used the card for stock at times over the past 5 years so there was always quite a big balance on it.

Worst thing is, there was a stage where I actually would have needed to use the PPI and I didnt even know it was there or understand it.
