Claiming IB again?

If you're kicked off IB (and loose an appeal) after being on it for several years can you make a fresh claim for IB or do you have to make a claim for ESA?

    All new claims since the end of October 2008 have to be for ESA (unless claims are linked and in this case they would not be).

    It is when someone chooses leave IB to start work and then reclaims due to ill health within 104 weeks.

    If you leave IB to return to your existing job but then within the next 104 weeks you suffer ill health, BUT this time the illness/injury is different to the original claim, would you still claim IB or ESA?

    Someone I know (early 60's) is in the position above and didn't know what to claim. He rang up JCP because he was confused and asked which one would he be better off claiming for and JCP couldn't tell him! In the end he asked them to send both forms.

    He has decided to fill out the ESA forms (based on any new claims after Oct 08 etc). One of the first questions was whether he'd claimed IB in the last 104 weeks. He has, so ticked yes (IB ended Sept 08), but then it said not to fill out the rest of the form and contact JCP. He rang JCP who said they couldn't find him on the system so told him to continue filling out the ESA form. :think:

    He's getting stressed and irate as it's only these last couple of years he's had time off work and had to deal with benefits/form filling. Until he turned 60 he'd always worked and never had to claim anything. I hate seeing him up so anxious and upset. If he knew from the start which benefit to apply for that would help matters.

  • Update on above: Had JCP ring him up...he should have gone back onto IB apparently and not claimed SSP. Now his boss can claim back the SSP. He's worried because he thinks if he has to pay back the SSP he can then claim backdated IB but it's only about half of the SSP paid. JCP will contact the boss apparently and ask him what he wants to do.

    Talk about confused. He asked for advice all the way through and the left hand didn't know what the right hand was doing. It's been stressful, confusing and if the JCP don't give the right advice to callers then how on earth are we supposed to understand it all.
