Halifax charging interest again on DMP

Halifax froze our interest at the start of our DMP 6 months ago but I got a statement today and they have charged interest and a late payment fee. I rang CCCS who said they would send our forms off again saying nothing had changed but is there anything else I can do. With them and Cap 1 still taking half the payment I am getting nowhere.
Thanks in advance for any advice.

HI there, this is happening to us with nearly all our creditors. Have you tried writing to them yourself? I wouldnt just rely on CCCS to sort it. Send a letter recorded & keep on at them

Hi
I'm in the exact same position as yourself. Like you I contacted CCCS who sent all of my details to Halifax, but the telephone calls continued night and day right up until 11.15pm at one point . I explained my situation to numerous people and it fell on deaf ears. I then decided to write including an up to date budget and a list of my creditors, still I got nowhere.
I then escalated it to a complaint and was told that they couldn't help me, I have replied but still I am waiting to hear from them.
Like you I want to pay them back and was doing so, yes it was going to take a while but they would have gotten every penny back, but now with their refusal to freeze interest and not accept my DMP my debt is increasing each month.
I have been advised to contact The FSO.
I hope you have more luck than me, but be prepared for a fight.DMP mutual support thread member:3270 -
The only thing you can do is try speaking to them/writing to them yourself explaining your situation.
What kind of debt is it? Credit card, loan, overdraft??? I only ask because I'm being nosey here, and having problems myself0 -
They have done exactly the same with me. Do you think this is some sort of systematic attempt to claw back more money before they have to publish their results to the markets and media?"Life is a sexually transmitted disease....... with a 100% mortality rate"0

It's a credit card debt newbeginning and feel free to be nosey as being honest is how we all help each other.
A guy at CCCS told me months ago that they were trying to get a law that if you were on a DMP then they had to freeze interest-anyone know anything about this?
I have been writing to Cap 1 for 6 months but they just ignore me completely or make excuses as to why they are refusing to listen. If they all start charging interest then what is the point of a DMP?
Very fed up, wish I didn't have a house or I would go bankcrupt so the greedy bxxxx's wouldn't get anything as I am trying to pay what I owe but it's not good enough for them. Does anyone think asking for a CCA would help?0 -
Reason I ask is we're on a DMP and have credit card, loan and overdraft with them.
The loan and credit card have accepted but the overdraft is charging me £5 a day, they added fee's which took us over the agreed limit, and now are charging like crazy!!
I don't know anywhere near enough about CCA to advise you on that, but I've Never-in-doubt will be able to help with that I think, if you post on this thread - http://forums.moneysavingexpert.com/showthread.html?t=2305463&page=640 -
It's an ongoing battle i'm afraid, but keep at it. I've been fighting this battle for 5 years with different creditors, some listen, some don't. Try their complaints procedure, follow that, then you can take it to the FOS.DFD February 2012

Does going to FOS help? If so how-has it got you anywhere?0

Elennor there's a thread about the legal protection for DMP's. I think it's called "What ever happened to Legal Protection for DMP's?" started by Blind As A Bat.
I'll have a look and post the link to it here shortly.
As promised:

I have posted on this thread in a kind of "devils advocate" way. I'm not on a DMP but I feel as though I am noticing a trend regarding creditors and interest. All I ask is that you would keep an open mind when you read my posts, they're not intended to offend or judge anyone on a DMP. As I said, playing "devils advocate" and looking at it from a different perspective.
I would suggest you all post on the thread and make it more prominent.

This is standard HBOS practice. I went down their complaints procedure but got nowhere. I made also made a Subject Access Request to check my CCA and try and work out their logic. Interestingly I found references stating I was paying too much (I had continued to send them my pro-rata payments and was/am doing a self managed dmp) and that this was causing them to delay sending my case to their in house collectors Blair. Oliver,Scott who would stop interest!
I queried this and they did not deny this was the case (they couldnt as I had it in writing).
To cut a long story short they couldn't produce a valid CCA and the rest is history.0
