broken phone 4 months old, no reciept, Argos will repair if I pay

Bit fed up!!!
My brother bought my daughter a mobile phone from Argos on the 27th March.
A couple of weeks ago it stopped charging up and went dead.
I phoned head office first to explain that we couldnt find the reciept and that I had the date of purchase and it was a cash sale.They said it would be traceable.
I went instore with my phone and they said the best they could do was send it for repair but I would be liable for any charges.:mad:
My point is surely they could trace that phone had been sold on that day with a cash transaction at an approx time?
Also the phone repair should be able to take codes from inside phone etc to find out when it was registered etc?
This was over a week ago and ive still heard nothing.
Any help would be most welcome.

You are not liable for charges, you are entitled to a replacement or a refund under Sale of Goods, product 'not of merchantable quality'. They can insist you give a receipt for a refund, but are obliged to replace/repair free of charge even without a receipt.
If they are doubting you actually purchased it from there, insist that they audit trail your transaction. You shouldn't be shelling out more money just after buying a new phone!0 -

Happy outcome..........Amazingly a few minutes after my second post, My telephone rang, it was Argos saying my phone was back from repair and there was no charge.
