WTC problem

I informed WTS that my self employed husband made a loss last year (apparently the loss can be offset against my salary) and have been waiting to hear from them. I rang for an update to be told that because my husband's self assessment was returned late I will not be allowed to use that loss.
The reason why the self-assessment was late was because he had opted to send it online but there was a problem or 2. He couldn't log in to complete the assessment and rang the tax office to be told that he was using the wrong NI number. To cut a very long story short the tax office had the wrong information on his file including wrong initial, date of birth and NI number. I have a letter from HMRC stating the above and apologising.
Any advice on how to get this decision changed? he self assessment was sent to HMRC on 6.2.10 and that was because we had to wait for a paper tax return form t be sent out to.:mad:
