Advice needed regarding an Ebay sale

Hi
I sold a pair of brand new with tag trousers on Ebay. The trousers stated the size, as was stated on the tag. They are from a well known shop, and make.
The buyer contacted me to ask what the wasit measured. I measured aound the top of the waistband, and told her what it was.
Buyer has received the trousers and says they do not fit. She measured the waistband just accross the front of the trousers and they were 2" smaller than I measured them to be.
I was always told to measure around the waistband, and not just accross one half eg the front.
The trousers also fitted me when I bought them, and I was the size stated. Unfortunately, I then discovered I was pregnant, and won't fit into them for a very long time!!
I have offered the buyer a full refund including the postage she has paid, but that she would have to pay for the postage to return the trousers to me. She states the she is not going to pay for the return of the trousers.
Am I right or am I wrong? I have excellent feedback and have never had problems like this before.
I generally just resell items if they don't fit me, as I feel it is not like going into a shop and buying something....you have the option to try things on!
Your help would be much appreciated!!
Thanks

You don't have to pay her return postage... but she can't expect you to refund without having sent them back.
Strictly speaking, if you have made a mistake, you'd ideally be paying postage... but it sounds like she may have measured the trousers differently to you.
You could say that once you receive the trousers back, if it is then apparent that your measurements were incorrect, you will refund her postage. You'll probably get a neg or a neutral if you don't refund her postage... but that's your call.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
If she paid via Paypal then they will tell her to return them to you with her paying the postage to you so yes you are right.2025 - finally back comping after a stressful house move - send me fairy dust please!

Hi,
I'm a seasoned ebayer (1400+) and frankly I dont think your buyer has a leg to stand on.
You provided all the info you could - including a measurement of the actual waistband & not just what the tag says - and I think no buyer can ask for more.
However, IF your buyer paid with Paypal and you DID NOT send by recorded/special delivery (ie trackable means) then she may be able to do a (fraudulent IMHO) chargeback. But only for the original cost inc the P&P she paid to receive item - she would have to return to you, by trackable means, at HER expense before PP would even consider a refund.
If she paid by another method then I would say you are in the clear.
Most sellers wouldnt have been as compromising as you - I buy things often & if they dont fit, but the size given or measurements were accurate in the listing, then I just resell.
Personally I would tell the buyer that although you are sorry that she isnt happy that the item was as described so you are under NO obligation to refund.
A neg is only a small red dot in cybersace and potential buyers will see it, read what it says - and the calm, factual response you will no doubt leave to it, and see that your buyer was being unreasonable
)
Good luck & dont let this put you off - ebay can be a great place but just ike the rest of life there are always numpties to deal with.

Have just had a message from her:
"well what are you going to do? i have got to sign off in a minute got to get on. i have to find some thing to put the trousers in now, then i have got to walk into town not today, and que at the post office to send them back to you and you want me to pay!!!"
Lovely attitude!
So I have said that I am not under any obligation to refund, and was doing it as a gesture of goodwill, and if she claimed through Paypal, and she happened to win, she would have to pay return trackable postage.
First time I have ever had problems.
It is such a shame, becaue Ebay is such a good way of buying/selling!
Thanks for all your advice!!

If she'd bought them from a shop she'd still have to take a trip to return them. Perhaps she's just a bit down because her waist isn't quite as slim as she thought. I always have a problem with trousers being too small
Can I help?0 -

A quick update, buyer has agreed to pay the return postage, and I have said I will refund through paypal once the item is received.
Thanks all for your help!!

Good grief, I do detest these buyers that complain about 'fit'. Like it's supposed to be your problem. Most things I buy will not fit me but unless badly described I would not dream of asking for refunds. When I go into shops most things don't fit, whatever the numbers say, that's why women spend hours looking for a pair of black trousers - why on earth would you get it right just by looking at a photo on Ebay!

Good luck dealing with her, sounds like a lovely lady...:wall:0
