    Is the lady actually going into residential care or are the council just sending someone to take over the carer's job for six months? I think your friend may be in for a shock when the respite care ask for the car so they can take her out.

    Also, if I were you I'd phone the council. We must not let people take advantage of those who need our help.


    This lady actually lives with this person. When she goes to respite she either goes to a another carers home and stayes, bit like children in foster care i suppose, or she has been taken to an old peoples home if no carers available.
    The car is seen as a perk of the job, can't see most of it being used for that person when a taxi will still be collecting her twice a day and when she is on maternity leave she will be visited once a week if that.

    I have just been informed I am no longer to receive the highest rate
    of D.L.A (which I have had now for over two years) which I had
    been using to get a new car under the Motorbility scheme.
    My question is: Can I carry on using my car during my 'appeal'
    and IF so, do I have to pay anything IF my appeal fails?
    I have a friend who was in the same situation, but she got a
    solicitor fighting for her and she managed to keep her Motorbility
    car for 8 months AFTER her top rat was stopped. Sadly she lost
    her appeal, after 10 months, but Didn't have to pay Anything
    for the extended period she had the car.
    Sadly, I can't afford a solicitor and just wanted to weigh up my
    options BEFORE I have to return my beloved car.:(

    To answer the first question, in my experience the car should go along with the lady to residential care. The car will be in the service users name or an appointees name so the support worker will not be able to keep the car.
