Holiday pay for casual worker.

Hi all,

This statement is at the bottom of my condensed timesheeet that was sent with my most recent payslip.

"The hourly pay rate is inclusive of a payment for each hour worked in lieu of holiday pay. This amount is calculated at the rae of 1 hour for every 12 hours worked."


Evidently I am receiving rolled up holiday pay and this will be addressed next week. But I'm mainly questioning the calculation used for working out the "inclusive holiday pay". 1 hour for every 12 seems to me to work out to be the same as 4 weeks for every 52 and I thought workers were entitled to 5.6 weeks for every 52, implying the inclusive amount should be something like 1 hour for every 8.5 approx.

Can anyone confirm my understanding? And maybe offer advice about how to bring this up without jeopardising my hours as a casual worker. I loie the work, but ased on my hourly rate, this could be a faiir amount of money over a few shifts.

    Thanks for that but i'm unclear what you're getting at. I understand your calculation and see that 28 days is 4 7 day weeks per 52 week year, but understood statutory minimum holiday to be 5.6 weeks nowaday, and yes, based on a 5 day week, that's 28 days.

    Could you perhaps clarify how your information helps me with my per hour calculations? I need it per hour as my employer and pay works by the hour, not the day, week or month due to my being a casual worker as and when needed.

    Casual or irregular working patterns If you work casually or irregular hours it may well be easiest to calculate the holiday entitlement that accrues (that is accumulates) as hours are worked. The holiday entitlement of 5.6 weeks is equivalent to 12.07 per cent of the hours you worked. The 12.07 per cent figure is:
    5.6 weeks' holiday, divided by 46.4 weeks (being 52 weeks - 5.6 weeks) multiplied by 100 = 12.07 per cent
    The 5.6 weeks have to be excluded from the calculation as you would not be present during the 5.6 weeks in order to accrue annual leave. For example, if you had worked 10 hours, you would be entitled to 72.6 minutes' paid holiday:
    12.07 per cent x 10 hours = 1.21 hours = 72.6 minutes
    The holiday entitlement is just over seven minutes for each hour worked.

    So for 12hours you should get 1.4486 hours = 86.9 minutes

    They are a bit slow in sorting this out the rule changed a while back.
    They have also got it wrong woops.

    How much holiday do the full time workers get they may also be getting wrong holiday
    (this may be a way to get it fixed get someone else to complain)

    When you say casual what sort of pattern do you work?

    rolled up pay is not allowed.

    You can be paid as you go but is must be seperate on the pay slip and you must be taking time off.

    There needs to be gaps in the employment but I canot find any rules on this
    (NHS zero hours are done with holidays paid as you go)

    If you work irregular hours but every week then they should really be paying this as holiday pay when it is taken

    In that case, they are right to compensate you only for the other 20 days a year.

    This is not correct.

    The holidays must be based on the equivilent of 5.6 weeks(28 days min for a 5 day week).

    Thanks team for the input there.

    Loks like I;m not the only one who's confused about holiday entitlement and the last couple of years of changes though.

    I like what someone said about full time workers, but I think they just get minimum equivalent to 5.6 weeks in hours.

    As for my pattern, it's as and when needed some weeks can be 90 hours, some 0. The hours are not as bad as they look though.

    The 12% approx value is what I thought it should be, I just think the office haven't kept up with latest legislation as payroll is contracted out, so it's possible the paperwork hasn;t made it everywhere it should.

    hi, would be grateful if someone could work out my holidays.

    I work 2 full days a week Tuesday and Wednesday (16hours). work said im only entitled to 9.5 holidays a year but by the calculator on the business link it said i should be entitled to 11.3 ( whatever the 3 means? not sure). and if this is right how do i bring it up with my employer?
