Capital One PPI - Here we go!!

Well.... I never realised a phone call could annoy me so much!!..
My wife, for months and months has been paying her Capital One credit card, and each month finds that she is so 19p over her credit limit!. She makes overpayments, and still it reduces no more.
She rang to see what was going on, with me frantically in the background asking her to ask if she's paying for payment insurance. "I HAVEN'T GOT IT" she replied.
Surprise, surprise when she did ask, she was told that she had been paying £20 a month since 2003!!!!!!!! furious, she said she wanted to cancel it immediatley, as I am covered through work. Thats when the fight started. Some rude and obnoxious man took it upon himself to argue that my wife had to have payment insurance. Needless to say, I took over the phonecall and it is now cancelled.
Thanks to this site, I compiled a letter to claim the PPI back and have sent it recorded mail today.
I will keep the thread posted with any updates. If I get nothing, then so be it, but if you dont try, you'll never know. To those that are umming and arring, get the letter sent, it's worth a go!!

**Update**... Letter recieved yesterday from Capital One saying they are looking into the account and will respond within 4 weeks..... any longer than 4 weeks they said they'll wirte and explain why.... pah... they get 4 weeks in my view. I'll keep you updated on any more updates.. usual terms of engagement apply, nothing over the phone and everything in writing...0

Gutted... had the response letter back from Cap 1 and basically they are not refunding the years of PPI my wife has paid on the grounds that... the application was online and therefore she selected and went through the process being told that she was buying a credit card with PPI, and the process involved her being told on numerous occasions...allegedly.. and that she has had ample chance to realise she was paying PPI as it is listed on her statements.. even though they changed her to paper free statements, oh and then wife found she couldn't go online to check, and has therefore for years been checking her balance and payments via the automated phone system.
And.... having mentioned the fact that capital 1 had already been prosecuted for similar stuff, they have said that my wife doesn't fall into this bracket as she purchased her card before the prosection (she brought it in 2001 prosecuted in 2003 I think, without checking the fact i put on the letter.)
So, in a nutshell.... gutted0 -
if you still feel you have been miss-sold to then your next step is to refer your complaint to the FOS,
go to their website and down loan thier consumer questionaire and send it back to the FOS,
it will take a little time but at least someone un-biased will take a look and make a decision.
you need to bear in mind that if capitol one were fined in 2003 it was probably for things they were doing in 2001 etc.

just a thought,
i am assuming it was their final response,
if it wasn't their final response you could write to them and ask them to re-consider and re-affirm your reasons once more where they are applicable.
it could still be quicker than going to the FOS.I'm proud to say that the banks no longer take money from me after becoming debt free0 -
ok... I'll try writing to them again...... and just see where it gets me, nothing ventured and all that..0
