Delivery issues...

Options
Hi all, i wonder if anyone knows where i'd stand regarding the following and a subsequent claim for consequential loss?

I ordered items online on Weds 24th March, as my order exceeded £100 i was given free delivery although i ordered after the cut-off point for std next day delivery and had to wait until Friday 26th.

I was issued with a tracking number via City-Link and arranged the day off on Friday as the delivery schedule was the usually vague "between 0830-1730hrs". Nothing arrived on Friday so i contacted the supplier and was advised that the goods had been mis-routed and sent to a depot in Devon in error. I was then advised that delivery would take place on Saturday 27th between 0830-1200hrs...

Saturday came and went and i fired off a rather annoyed email to the people concerned. I also called City-Link who advised me that delivery would actually take place on Monday 29th and they were very sorry for the inconvenience.

Monday 29th has seen, guess what, no delivery... i've now been told that it'll be coming tomorrow (Tues 30th)

In response to this, i've contacted the complaints dept at City-Link who have sent me a rather nice email advising me that it's tough and that i need to make a claim to their customer and City-Link might consider it. I've now asked the original people four times for the name and contact details of the person i should write to and, on each occasion, i've been ignored. My message has been responded to on each occasion but no mention of the complaint or the relevant contact has been made. I've now asked for a final time and advised them that it's next stop Trading Standards if they ignore me again.

So...

1) Can i make a claim for consequential loss with my supplier given that i've lost Friday 26th, Saturday (AM only) 27th and Monday 29th? I might add that i'm self-employed so not able to even take holiday to cover my time. I may even need to add Tuesday 30th to the list if they let me down again.

2) If the delivery doesn't arrive tomorrow the order will be cancelled although i've been advised that, as per their T&C, they (the suppliers) will deduct all delivery costs from the refund - even though i wasn't charged for delivery... they also state that i'd be responsible for the items being returned to them via City-Link and that they'd deduct that fee from my refund too.

3) Trading Standards - is this the sort of thing they'd be bothered about or am i over-reacting just because i'm annoyed at the lost time and failed deliveries?

Many thanks for any advice.

well i believe as its a personal purchase you can have a full refund under the distance selling regs(unless its a custom item)
if it was a business purchase you would have less rights
