    They can take it under their right of 'offset' to pay whatever you owe in full. Obviously, the cat is out of the bag now, regarding how much you have available, so they may even withdraw the £1600 offer and want 100%. Put the money somewhere else and deal with the rest of your creditors - and pay any surplus back to MiL. I think you may not be able to do F&F with them for a while.

    OP ideally MIL should have kept the money and if you got F&Fs agreed then paid it over direct - this obviously keeps the money safe but usually when people write to offer F&Fs they say that a family member is offering the money (so that creditors cannot refuse the offer and demand any money you have put aside for the F&F).
    If the family member is offering to pay its preferable that it is them that actually pays.

  • Lyndzzz Get the cash out quick, these thieving besterds can take money in a flash, try and get it back in a hurry too! Best for whoever gave you /loaned you the money to keep it in their account and you can ask them to draw down on it as and when you need it. Don't take any chances mate!
