Ebay Purchases - Would You Neg!

Looking for some advice.

This week I've bought a few things from ebay - mostly items that have sold for under £1 or so.

Two items I bought absolutely stink, stink, stink of stale cigarette smoke (two different sellers), revolting. One of them is a dry clean only item, so is lingering in a carrier bag in my hall as I type. The other one I flung in the machine straight away.

One item I bought had a stain right down the middle - not a big one, but still stained. I contacted this seller and she said send back recorded. Will do, but haven't yet as been working all week, so first opportunity will be Monday.

Now, the two stinky items I'm happy to keep as I can clean them up, the third item I don't want back even if she can remove the stain (looked like curry sauce!). But overall the quality is carp!

On the other hand, I've had some amazingly fab purchases amongst these, that I've no hesitation giving huge praise too.

I don't want my money back or owt from the smelly ones (I do from the stained one), but it's a bit yuck isn't it.

Would you neg?

The stinky ones - Not unless they had in their listing that it was from a non smoking home.

The stained one possibly, depends on how the seller reacts.

Would you be able to claim 'ITEM NOT AS DESCRIBED' in these instances?

I bought a dress last week that was listed as new without tags and when it arrived it reeked of smoke...now sometimes I get parcels that smell of smoke on the outside as I know our postie smokes on his van (not allowed but anyway) but this was definitely from the clothes...IMO its not "new" if it stinks...however it wasn't listed as from a non smoking house so the risk was on my side really.

Anyway I sent the seller a very polite email and I got a refund....so I wouldn't automatically leave negative try the seller first and see what they say?

I do think that something that is stained shouldn't be sold. Most people who don't smoke do put that in their listings, I would assume that if it didn't state from a non smoking house that it would be smoky.

Hmmm, good point re: the listing not saying from a smoke free house. But then, I don't smoke and wouldn't put that down, so never really thought of it. I used to smoke, but never, ever in the house (but I've got kids, so wouldn't).

I guess it's just standards. I don't really want refunds, as both the smoky items are good - just smelly. The one washed I've just checked, and it's still got a linger after being in the wash by itself with bold and comfort! I've just popped it in again for a second round to see if that improves it.

    Thanks for your advice.

A SNAD is pretty much the opinion of the buyer . If it was the sellers. there would be virtually no refunds at all . If buyer considers an item unwearable because of the smell (or dirty) then it is not as described because implicitly the item is wearable when received unless otherwise stated.
