Filed claim agains Lloyds TSB for CC charges -need help!

Hi,

I recently filed a claim at Moneyclaim.gov.uk aginst Lloyds TSB for around £500 of credit card charges. It was issued on Tuesday 16th March 2010 and considered served on Sunday 22nd March. My only concern is that it was served at the wrong address. I used the address that I had been using to correspond with them, which was:

Swalow House
10 Swallow Street
Birmingham
B1 2AL

I then realised that I probably should have had it served at their registered office, which is:

25 Gresham Street
London
EC2V 7HN

I rang the Moneyclaim helpline and spoke to a man who said that he couldn't offer any legal advice, but that he would probably wait and see if they responded. He did, however, send me some forms so that I could change the defendant's address, without charge, if I wanted.

I was going to wait, but received advice on here that Lloyds would probably look to over-turn the decision if it wasn't served at their registered office.

Anyway, I filled out the form, which was probably received by the court on Wednesday 24th March, but the status of the claim changed to 'Acknowledged' on Friday 26th March. Does this mean that, because Lloyds have acknowledge it, I no longer have to worry about the address? Or does it mean that it's too late to change address and they can weasel out on a technicality?

Any help would be greatly appreciated.

Regards,

Rick

  • That means that they have received the claim where it is required to have been received.
