How much notice?

I am currently under three months protective notice after which I will be made redundant if my employer can't source the money to keep me on. I was wondering that if I find a new job in this three month period, how much notice do I have to give my employer? Under normal circumstances it would be a month, but do I have to give any at all given my current circumstances?

    Yes - you are contracted to give notice in line with your employment contract. It has not changed that.

    Your normal notice applies.

    You resign and leave at the end of the notice or some mutualy agreed date before.


    It might be better to negotiate an early leaving date for the redundancy so you still get that paid.

    If at the end of the 3 month period, you redunancy is confirmed, are you expecting to receive a worthwhile compensation payment?
    If not, ask your employer if they are willing to waive their right to the one month's notice from you if you simply just resign. An advantage of this is that it could save your emplyment from having to produce a case to justify why you were chosen, so it can be turned into a win-win situation.
    Alternatively, if compensation due is worth having, try to negotiate with your employer to let you go on "gardening leave" until the end of the protective notice, then give you a Payment In Lieu Of Notice (PILON) instead of requiring you to work your actual 1 months notice after your redundancy has been confirmed. They may also need to agree to let you work for someone else whilst they are paying you, other wise you could lose your right to compensation.
