unpaid item mutual agreement request after refund

I bought two items from the same seller recently.
Their listing gave a delivery time of 1-3 days. On day five after not receiving anything I emailed them. Day eight after no reply I phoned them, and was told I 'd be rang back the same day but was'nt. Day ten I filed a paypal claim to get my money back.
I was awarded a refund from paypal as they did not respond to the claim. I then left negative but fatual feedback (No item received, no response to phonecall, claimed from paypal) to which they replied (Bad Ebayer ***Our feedback says it all ---- this one not to be trusted)
Now I have received a Unpaid item mutual agreement request from them. I don't quite understand how that works when I paid by paypal and then got a refund back for non delivery. What happens if I don't reply? Will they get their fees back and an unpaid item strike against me?
Any help appreciated, as I not sure how to reply.

Reply to it and say what has happened - surely paypal will be able to see that you paid for the item and filed a dispute to which you won. Is it a feedback removal request or a dispute?Weight Loss - 102lb0

Sounds like a request. I can see no grounds for compliance though; negative feedback is there as a warning to future prospective buyers.Can I help?0

This sounds more like the buyer has filed a NPB and chosen the mutual to get their fees back, and since you had to go to paypal to get your money back I would choose the option that you're not pulling out of the sale as the seller will still have to pay their fees and can't file against you againTitch

That's exactly what he wants. He wants me to say weve both agreed not to proceed with the transaction, so he can have his fees back.
What I don't understand is how he can ask for that when the sale was completed as I paid instantly through paypal. Although it was refunded eventually.
What I was worried about is how it could affect me if I agreed or not.
I'm not bothered about the feedback as I think it was warranted. The feedback he left me was obviously done in retailiation. I left a follow up to it anyway explaining.
I will do as you suggest and reply that I'm not pulling out of the sale.

You must reply to the NPB process. He can have your neg removed if you dont.0

Won't their neg be removed as they didn't respond to your dispute?My TV is broken!

I was thinking the same fay, I thought that if a seller didn't respond to a dispute then they couldn't leave a neg but reading the OP again I think the seller replied to the neg rather than left a neg too.:heart2: Love isn't finding someone you can live with. At the moment it is only when a buyer doesn't respond to the dispute that the negs are removed. if a seller doesn't respond feedback is unaffected. There were plans by ebay to change this but it seemed problematic and it appears to have been put on permanent hold.
Going back to the OP. Respond formally to the request. Tick the box that you do not agree with th emutual, ie that you wanted the item. The dispute will then be closed, there will be no strike against you and the seller will not get back his fees. If you do not respond to the dispute he will just get his fees back and your feedback may be removed.

Ah I see. That's rubbish rules by e-bay. So a seller can rob you blind then lie about you in a neg without it being removed (assuming the buyer doesn't respond) but a buyer can't tell the truth about a seller because it will be removed (assuming the seller responds):heart2: Love isn't finding someone you can live with.
