    argghhh dont scrap it! sorry should have said that before. get it back and take photos - lots of them. but keep the caravan in case the court wants an expert opinion.

    The Sale of Goods Act may apply to contracts between private individuals however only parts of it. If you buy from a private individual you can expect for the seller to have the right to sell the goods and for the goods to be as described.

    Did he describe it as a wreck full of damp? Or as a working caravan?
    I do agree with you regarding this point, its all about proper title and description rather than quality, which doesn't apply. Issues about quality aside, it's how the item was described and sold will be the issue of whether the OP can do anything about this legally. AFAIK an omission of a fault wouldn't be enough the seller would have needed to deliberately misdescribed/missold the caravan, ie, if the OP's mum had asked the question "is there anything wrong with the caravan" and the seller said no then potentially he may be liable.

    thats why I said to keep the original advert - if it was described wrongly then the buyer has a case.

    Not quite sure how anyone could " cover up " damp walls that are now falling off in a caravan?
