daxon charged for 1day late payment

having paid the good 10 days you should before the payment is due - daxon are now saying the payment was 1day late and are charging £12 for the privelege....i am in credit anyways as i always round my payments up - £4 would be £5 and £7 would be £10, etc - i phoned and said as i was in credit by about £18 - the £6 payment due could come out of that anyway, so i am not late paying - they dont agree and said i should still pay the charge - i am now going to pay the account off and take away the £12 - can i do this?

    Yes, they are penalising you, which is not lawful for a breach of contract.

    What don't thay agree with? The fact you payed the bill 10 days before it was due? When did they say your payment was received and when was it required to be paid?

    I would have thought the £6 would have come out of your credit balance. Have you any proof you were in credit? Did the £6 cover the goods you had purchased or was it the extra you needed to pay - ie. the difference between the goods bought and your credit balance. You say you are considering to "pay the account off" but why pay more if you are in credit?

    £12 does seem excessive - it might be one of these one illegal charges people are claiming back off there banks in this forum.

    I am pretty sure that catalogue companies still insist on minimum payments even if you are in credit.

    i only owe £52 in total - the minimum charge was £6 but i was in credit by £18 so, there was only £34 to pay off the account - i have no intention of paying £12 when i know i paid it in good time

    When you say you paid in good time, how did you pay and how many days did you allow?

    For example if you put a cheque in the post it might have been a few days before they got it.

    I believe the date they give you is the date it should REACH your account.
    Posting payment is always risky because of potential delays/loss by royal mail but other methods still take time.

    You could try another approach and ask them for a goodwill gesture as you think it's a bit over the top for a loyal customer in credit. Always worth a try. You might get further by being a bit charming that arguing with them.

    It's probably better to sort the problem out rather than to simply not pay the £12 as they may default you and it could harm your credit score.

    Put the issues down in writing to them, including dates and method of payment sent, and details of balance and purchases at that time, and someone at their end should be able to see that they have made a mistake (if that is the case).
