    No you don't have to go to a hearing it will be dealt with internally.
    Because your case involves years which have already been finalised and closed there are legal issues regarding going in and re-adjusting the entitlements whether it's in your favour or not.
    I'm not 100% on how that works but that's why staff in the contact centres cannot fix this themselves. Your appeal will be passed to a particular group for consideration.

    Hi Christine.

    I myself have just sucessfully received a payment of backdated tax credits.

    Like yourself , i informed the tax credit office know that my daughter had been awarded DLA.

    I had applied for the DLA in March 09 and had to go to a tribunal to win the DLA in early October. That same day i telephoned the tax credit office to tell them we had won at tribunal and the lady said "well in aa case such as this , we will be able to pay you right back until March 09.

    A month or so later when i received my new award notice , i had only been back paid until 5th July (three months from when i informed them) .

    For a month or so i just accepted their decision and forgot about it and then i got round to thinking "hey it wasnt OUR fault the DLA decision took so long to be made!".

    So , i wrote out a letter to the tax credit office , simply saying i wasnt happy with their decision and set out my reasons as to why i was unhappy , i then got a letter saying "we will look at your claim again and contact you within 5 months with a decision.

    Just 2 weeks ago i had a lovely hefty payment into my back account so im well pleased lol.

    To summarise:

    Very early Decemeber im told it will only be backdated 3 months

    Early January i write them a letter appealing their decision.

    One week later i received an acknowledgment letter.

    Mid March my payment goes into my bank account.

    One week after the payment goes in i receive a letter telling me my appeal was successful.

    hope that helps some what.

    To any one else reading this , i would advise that you ALWAYS appeal if you think a decision is wrong , you have nothin to loose.
