ebay who pays postage on a returned item

hello i bought a item on 16th march cost £56 + postage of £8.65 i asked the seller if the item was black and from argos he said yes i believe so in his email so i bid and bought anyway

i have received the item in the correct box the picture shows silver on the front and the item is silver i wanted black any way he has said today if i post back the item he will refund me £56 but what about the postage i paid to get the item here £8.65 then it will post another £8.65 from my end is this correct i post the item then keep my receipt hoping he refunds me
plus what happens regards postage who should pay

    OK, if its a business seller and the fault is not the buyer's then it is the seller's responsibility to pay return postage, you can insist that they pay before it is returned or that they arrange the collection.

    Paypal do not refund the return postage because they never hold it, so can only refund what they initially have.

    If its a private seller then you still have the same rights but it is trickier to enforce. Sometimes it is easier to accept that you won't get the return postage back merely because chasing the seller for it is too much hassle.

    In short, the law states that if you purchase something and it is faulty then you should not be in a worse position than before you bought it. Interestingly this can be applied to high street stores too, so in some cases you could ask for travel expenses to the store.

    thanks its a private seller with 6 feedback i have since emailed him he will only refund the £56 the cost i paid for the item he will not refund the postage i paid him for it to get from his to mine (£8.65) so therefor for me to return it i have to pay my end so im paying out 2 lots i dont mind losing out the postage my end (well i do but i have spoken to paypal im not entilted to the postage costs this end) any ideas

    i do not want to leave a negative as to be honest he his trying to offer it to the person who bid before me and he has been pleasant in his emails as some sellers just ignore you

    He will be pleasant when he's having you over.

    He wants you to be £17.30 (postage x 2) out of pocket through no fault of your own and you don't think that deserves a negative.

    Go through Paypal, they will refund the full amount paid including postage if item not as described, no other way around it if he won't give it you.

    Yes, when instructed by Paypal, send it back trackable.

    Yes, if the trick is to get yourself suspended from ebay for feedback extortion.

    Every seller knows a buyer can neg them, saying "I'll neg if you don't do so and so" is just asking for trouble.


    OP, go to Paypal, open a Significantly Not as Described dispute. You'll have to return it at your own cost by a trackable method (so a courier Paypal know about, or recorded* post) but will get a full refund of the amount you gave the seller.



    * I wouldn't use recorded in this case, if it goes missing you'll only get £39 compensation from Royal Mail, and that's if they pay out at all because you sent something of a higher value than they say you can for that service.

    Make sure you send it via a reliable on-line trackable service (ie not recorded!) as if Paypal can't verify it's been delivered, then they will not pay out. If they can verify it, then they will refund you the cost you originally paid plus the original postage. Also, make sure that whatever method you use, you get proof of postage and adequate insurance to cover the full value - just in case it goes missing and you have to claim from the postal company.

    Return postage comes out of your pocket I'm afraid.
