KeithP, what would they have to have done to be classed as a different company?
The company number shows the details as above, and showing as active since 2008.
What is different is the telephone contact number plus the name is changed on the website, but am I getting confused here between the name of the "shop" and the company numbers name?0 -
It is not unknown for directors of a company to purchase the assets of a company in administration and continue trading. If that is the case here then your chances of getting any money back is virtually zero.
Surely the Administrators should have some courtesy / interest to have informed me of this, their distinct lack of communication left something to be desired.0 -
One of two things has happened.
1. This is a "phoenix" company. Ie the original company went into administration, all assets stock etc was sold to a new company (new registered number etc) who are trading in a similar style. Its common for these companies to have the same staff, directors & shareholders as the now defunct company. Is it immoral, probably. Illegal, no.
2. The company went into administration, so protected itself from any action from creditors. However it may now have ceased to be in administration and is trading as normal. This is possible, but extremely unlikely.
You need to know the EXACT trading style of the company you placed the order with or the registered number. A company can change its name as many times as it likes, but the number will remain the same.
If i were a betting man, i'd wager its a phoenix company. If you PM me some details i can offer more concrete advice0 -

In your original post you said the company had changed its name but the company number was still the same. That means it is still the SAME company!
A company is simply a 'legal person' If a person changes their name they are still the same person and their National Insurance Number remains the same!0 -
Thanks Paul, what I had failed to notice is the fact that the "old website" whom I purchased from linked to the new company website and so this lead me to believe it was the same company. hippyadam explained further about how the "phoenix" company thing works and further checking for me via pm showed they were "different companies" so I am at a loss. I now realise I jumped to the wrong conclusion way too quickly and too naively with not knowing these things.
I appreciate everyones responses and help on this.
What does annoy me is that I recieved another email flyer for the new companies services..... should I send a email...but then again is it worth it as they have not done anything illegal0 -
Look would be better if you posted the companies name, it is not going to change anything at the moment and it could help the rest of us look into it a bit more to give you a better idea of where you really stand.
They have your money at the moment you don't owe them anything to protect their company name, even more so would be good as you will be protecting others that may wish to purchase from there0
