NPS - what action to take

I bought an item on the 7th march, i paid striaght away as it was a BIN. On the 18th march i emailed the seller and i got an automated response of ''im on holiday ill get back to you when im back on the 19th''.

The auction did say 10 business days for shipping which i thought was a buffer for slow royal mail service. Not that he would actually wait 10 days to go to the PO.

As nothing had arrived this morning i emailed the seller again asking where my item was.

To be told that it was due for desptach today, but he'd refunded me now as i was rude asking where the item was as it clearly stated 10 days and if i had wanted the item quicker i should have emailed and he would have posted it quicker.

He then also sent me a cancel transaction form stating that i was rude and threatening and i was now banned from shopping with him.

I emailed back stating that even with 10 days for despatch that would have meant he should have at least posted it on the 17th march and as today was the 23rd he was already a week late and if he could post it sooner why didnt he and why would i have to request it.

Anyway - do i agree to cancel the transaction? I want to be able to leave him feedback as i never got what i ordered and i really wanted it. He has 100% feedback and is a business but i feel that this is how he deals with all his customers. All he had to say to me was sorry ive been snowed under its on its way today and that would have been fine with me. Id have waited, i wanted my item.

    Don't cancel, if you do he can claim his fees back.

    Thats what i was thinking, i dont see why he should get away with it, it would have done him no harm to be polite and apolgetic and sent the item, im understanding i know things go wrong, but he didnt he basically said tuff, heres your money back. Then had the chek to accuse me of being a terrible buyer. Yet i fullfilled my end of the contract, i bid i bought, i paid, i waited.

    Do not agree to the "mutual request to cancel" and see what his response is, he may change his attitude

    Do you still want the item? If you do don't agree to cancel and maybe even pay again, send him a message saying you have paid and want the item. Or go elsewhere, plenty more polite business sellers on ebay who would be gratefull of the business like me :D
    Delays happen but i've always found being super apologetic to the buyer and keeping them updtated works, the majority of buyers are understanding and forgiving.

    I can get the same item elsewhere, i wont be dealing with him again, i sell myself so i know things go wrong, i would have understood, but now looking back through recent feedback he has taken weeks and weeks to deliver other people items and his stars for delivery time only has 40% response compared to the others stars, so i guess people just dont want to comment on that.

    I feel i should leave at least a neutral to warn others of his attitude and delivery times.

    You seem like a very nice buyer what would it take for you to neg someone? Or am I harsh?

    Get a negative left for him as a warning for someone else and don 't agree with the transaction being cancelled.

    As a buyer and seller myself, I wouldnt expect anything less. If you dont leave a negative, then he's likely to treat other buyers exactly the same.

    obviously it's your call on what feedback you leave, but unfortunately if his buyers keep avoiding leaving negs he will continue to trade, continue to be rude and abusive to his customers and in turn may well put some good people off buying from ebay, which will perhaps one day have a knock on effect to your own sales? Bad sellers should be pointed out when it's justified or all the good sellers end up feeling the effects and getting tarred with the "ebay is full of rubbish sellers" brush

    Sorry, but if he's acting an idiot and refusing to play nice, then why not leave a neg and warn others of his behaviour. If you'd done the same, you'd expect one
