Home Insurance Not Paying Out Due To Wii Remote Not Been Tight Enough!ANGRYFACE!

    I had an insurance claim on the council refused by their insurers when they smashed my car window with a stone that flicked up from a strimmer..

    Their reasoning being that all reasonable precautions had been taken and that the council chap hadnt been neligent in his use of the equipment and therefore the public liability insurance wouldnt pay out (or that jist - it was years ago!)

    Perhaps they believe you were negligent in not checking the strap was done up correctly on a 5yo throwing it towards the TV? (if done up correctly it wont come off)

    Just an idea?

    Unless there is a specific clause relating to using the straps then the OP would have to be deemed Reckless rather than negligent for the claim to be denied on the home insurance. Reckless is a different definition than negligent

    If you are claiming against another party's liability policy then you do have to prove negligence for your claim to succeed.

    Different rules apply when claiming under your own policy.

    Aviva have this exclusion regarding accidental damage:
    failure to use in line with the manufacturer’s instructions

    Maybe this is what they are relying on?? (The Wii instructions are pretty clear on wearing the strap properly).

    Not explained well, but this is what I was trying to get at..

    I'd expect the claim to be refused from my laymans point of view.. I guess the line between an accident and being careless is quite a fine one...

    Not really sure why as i'm not typically "holier than thou", but the attitide of "had i known i would have lied" kinda wound me up too! :beer:
