bank refused financial hardship

hello there i need some advice, i contacted my bank to claim my bank charges back as i felt i had fallen under the financial hardship bracket, i got a call about 2 weeks later and the chap went through my earnings and all my bills, now at the end of the exercise it turned out that between me and my wife we were left with around £100 spare money per month, i explained that i had arrears on a few accounts but they rejected the claim stating that because i wasnt in the minusses i dont qualify, should i drop the matter of contact the financial osbondsman? (sorry about the spelling)

    Do you have priority debts?

    Are your debts non priority ie credit cards, catalogues?
    The charges on them are reclaimable.

    Have a read of the lending code (page 20) and see if you still think you are eligible for claiming under financial hardship

    If you think you are, then go ahead and contact the FOS. It won't cost you anything and the worst they'll do is agree with the bank, otherwise expect an award of some compensation.

    thanks everyone, my depts are credit card arrears and a council tax bills and a couple of phone bills and a catalouge bill esculated by the fact of having to move house (rented) so ill let it drop thanks for the advice.

    Just to add, i did acctually try and reclaim catalouge charges but got nowhere with them as they were £12 per charge littlewoods seem very stuborn.
