Advice please

We've got a company coming tomorrow to do some work and today they sent the scaffolders in.
Athought the work is only on the gable end and back of the house the scaffolders have managed when moving the poles to smash a chunk of my original bay window trim on the front of my house along with flower pots but I don't care about them they can be replaced easily.
The window trim is early Victorian and quite ornate and this piece is right on the corner so you can realy notice it.
Where do I stand since I did'nt hire the scaffolders the builders did.
Can I insist the builder repairs it.

    You contracted with the builders to get a job done, their subcontractors have damaged something so its down to the builders to sort out getting it put right. You need to point out the damage as soon as possible, and don't be fobbed off - its not your job to sort it with the scaffolders or their insurers, its the builders that you have the contract with. However tact is always the best approach - don't start the job off on the wrong foot if you can help it.

    You can claim off either or both - the both owe a duty of care in addition to any actual/implied contractural performance.

    If the scaffolders have gone from site, speak to the builder, but don't let him pass this entirely onto the scaffolders. Of course he will want to speak to them first, and he will be seeking the repair costs from them, but from your point of view you just want to know that the builder will sort it out one way or another and you don't expect to have to be chasing the scaffolders yourself
