Bought new house, parking not as advised

    We asked this when looking at a new build and told that it was some governement initiative that when new developments are in a place with good transport links that houses are built with one parking space. Great if you can actually get to your place of work by public transport or you don't work shifts and transports not available etc.

    Was bad on the estate we eventually rented on. There were 5 houses in the row with 5 spaces and an additional 3 which had been 'landscaped' with some daft little tree as opposed to leaving it as the parking space which it was before which was far more useful. Really it was the reason we moved as there were cars all over pavements and you ended up having to walk in the road.



    OP- Hope you get something resolved eventually. Sounds like a great big balls up by developer. Might be worth asking your neighbours about the issue and keeping them updated. You may find more than one voice does get heard

    Update...one year on.

    Yippee!!!!

    After a year of wrangling we were in the County Court yesterday. We claimed against the builder for the loss of a promised amenity (visitor parking spaces) and the loss of the value of that amenity. They tried to get off by saying the contract excluded oral statements made prior to purchase (e.g. we were told orally by the sales office staff that there would be visitor parking) however we pointed out we were also showed the parking spaces on plans which formed part of the contract so it was written as well as oral.

    Anyway we got £3500 in compensation including our costs in full. Very pleased as they had offered us £500 not to proceed to Court but we rejected it. We still have no visitor parking but at least this is some compensation for that loss.

    Anyone know if County Court settlements set a precedent? e.g. can the neighbours on our street use this as amunition for all of them to get compensation too? Thinking about offering consultancy services to handle their claims for them given the information we have built up over the last 18 months :j

    Thanks for updating us on the outcome, I remember reading this when you firt posted and whilst cross on your behalf, had nothing useful I could say to help you.

    Well done for standing up for yourselves, taking on the builders and winning.....I hope that your neigbours are able to do the same.

    Nice result. Have you informed all of your neighbours too to see if they can get the same compensation?

    Im waiting to get the cheque from them in my hands first to ensure they are not going to appeal against the judgement. Then I will have great pleasure in spreading the news.:D

    Having re-read your update and county courts can't set precedents but with all the same evidence it is unlikely that subsequent cases would not go the same way.

    Your neighbours will certainly owe you a drink if they get anything like the same compensation.

    It's usually the case that only 1 car parking space is allowed by planning permission, rather than the builders choosing it.
