2 seater or 4?

A friend of mine has a Jaguar XK8 convertable,the log book and insurance both state this is a 2 seater but there is a back seat(of sorts)which has 2 seat belts and the car will accomodate 4 small adults.Question is if it's involved in an accident with 4 people on board will the insurance still be valid?

    I would check with the insurance company and try to get the confusion sorted - it may be that the log book needs modifying - Could be worth going to a Jag dealer for advice
