Tesco Pet insurance get-out clause?

I have just been reading a post from a person on another forum whos dog got in a fight a few days ago.
There was some damage to the other dog. The guy who posted has his dog insured through Tesco, so he rang them to make a claim for the vet fees to treat the injured dog.
He was told by Tesco that because his dog wasn't on lead they won't pay out.
He said he has checked his policy documents and it doesn't mention anything about the animal having to be on a lead to be covered.
Is this acceptable/legal?
I'm a bit concerned as i have my dog insured through Tesco and i would like to know that, god forbid she caused any damage to anyone, that we would be covered.

It depends on the full circumstances, for the other person to be able to claim against him he would have to be "Legally Liable" this in effect is was the incident "Reasonably avoidable".

I think there are a lot of clauses with the supermarket pet insurances that you have to be wary of (from reading other posts on mse pet forum). If you are concerned then I would ring your insurance and ask them to clarify. Check out the ones which are advised
