I reckon Aviva conned me!

I took out a small AVC ‘top up’ policy with CU Life several years back, since which they merged with Norwich Union, and is now part of Aviva.
In 2008 I think it started, Aviva announced they had some spare funds to distribute to policy holders, called a ‘re-attribution’ payment- subject to legalities, policy holder approval etc, approx £200 a person.
over the months, I got further bumf, and last year a voting card, which I duly ticked yes (easy money, I thought!), and got a confirmation shortly after..
In October I think it was, the scheme was approved, and payments were due to sent out by Christmas..
At the end of November, I got a letter saying I did NOT qualify?? (partly due to poor performance, and their charges, the policy is now worth jack.!).
Trying to get hold of someone who knew what was going on was a nightmare (left hand / right hand etc, emails bounced back, passing the buck..)
finally I got a response, confirming the above- as policy had no value, I was getting nowt.
Now I felt rather peeved by now- being led on by the promise of a payment, voting papers etc- surely they could have pre- screened the policies?
I did a claim to Financial Ombudsman, who replied saying they do not cover member type issues, and this does not count as a customer complaint.
So, who di I turn to, now?
I feel totally misled by Aviva, who I suspect got many approval votes with the promise of £200, only to turn people down.. by gettign this vote, they also avoid any liability for the perfrormace of unds, afaik?
