I need some advice. I have received a refund for Council Tax which came out the blue this morning. It is going back to 1999-2005 for the property I use to live in due to it being rebanded on Council Tax from a Band E down to a Band D. There is a refund due of over £1,000. Does anyone know if I will be allowed to keep this as it was prior to bankruptcy which was Dec 09 or will the OR want it?
I know that anything moneywise obtained during bankruptcy has to go to the OR but as this states on the enclosed letter 1999-2005 I am hoping I can keep it. Can anyone advise please. Thank you so much

Can you get the council to apply the refund to your new council tax account? (leaving you in credit). That way you wouldn't have any money being paid into your bank account.0

I did think about having paid onto this years council tax, but then when you think of the money and what you can do with it, just seems a bit more appealing (hope that doesn't sound greedy), but need to buy things for the home and it could do so much more than sit on my council tax account. thanks you really appreciate the reply.0

If it's as credit on your council tax account, that'd mean you could save the money you pay every month for council tax (I'm guessing around £100 pcm?) and spend that money on stuff you want/need. I think the OR is likely to take any lump sum paid to you, so it's your choice whether to be £1000 better off or to give the OR £1000.0 -
thanks. I appreciate it. It does make sense your right. but you always think to yourself wouldnt it be nice to have it now.!!! It was such a shock to receive it, you plan in your head what you can spend it on, but if I never had it I wouldnt be able to spend it.0

would I have to tell him even if I was giving the chq back to the Council and getting them to pay the money onto my 2010/2011 council tax account. If I havent cashed the chq or had the money do I still need to advise the OR?0

As it as acquired asset from before BR you need to inform OR within 21 days. The OR may or may not take an intrest depending on timescale it was for etc. It could be wrong not to inform if you credit your account and do not disclose this as per terms of your Br.
