item damaged

Some weeks ago I started clearing out my loft and selling stuff on ebay. I sold a digital camera. I got insurance for this item.
The buyer emailed to say that the screen was broken.
PO said I could make a claim if I returned the item together with the packaging I used and the label they stuck on the front.
I emailed the buyer twice to say this. He then opened up a dispute.
When I responded to the dispute to say that I would refund him when he returned the item to me with its original packaging he said that he had thrown the packaging away so he would close the dispute.
He did not close the dispute and ebay have now said that they will refund him if he returns the item to me.
Now if he has not got the original packaging, will this mean I cannot claim from PO and if not can I ask ebay to reopen a dispute to reflect the above.
This is the last time I sell, anything on ebay!!

    Sounds a difficult one, it maybe a case of the buyer just trying it on for a refund and you may never get it back.

    As for if it does comeback I am not sure about your money from royal mail, you may have a fight on your hands.

    The very fact he said he will close the dispute looks like he may have been trying it on.

    If I recieved a broken item I surely would not chuck the packaging and return the item.

    Maybe the camera never broke and he thought you'd give him an instant refund without returning it, and you sticking to your guns has put him off pulling a swift one.

    Basically if its legit you will get the camera back soon and have a fight with royal mail, if you don't get it back then it was probably them trying it on and the dispute will go away if not cancelled.
