Advice on dispute please!

Hi.
I recently purchased a blackberry from ebay and when it came it basically wouldnt turn on, and when it would it kept cutting out and stuff despite being advertised as BRAND NEW.
So I contacted the seller straight away informing him of this and asking for a refund, but i mentiond i would purchase a replacement battery if he would pay the cost for it to see if it solved the problem - to which he didnt reply.
I went ahead and bought the battery and it is still the same issue. I then opened a paypal dispute on the 16th explaining it all again but as of yet he hasnt replied.
Basically, I am just wondering how long you guys think I should wait on the paypal resolution centre before I escalate to a claim? I dont know if he actually will relpy but he hasnt responded to any of my emails and I know that if I ever got a resolution thing against me i would be on it asap!
I a hoping to get this sorted asap as it was a lot of money to hav spent on a peice of junk really, but obvio dont wanna close the dispute TOO early and give a bad impression on me either... thanks

Yeh I am not going to close it I will escalate for paypal. I just dont want them to think I haven't tried to communicate or anything as the seller hasnt responded since I opened the dispute 2 days ago and he also hasnt reponded to my own emails0

I have escalated claims within 24 hours, and I'm sure I escalated one immediately after opening the claim - I think this is reasonable if you're having no communication.Hope over Fear. #VoteYes0
