AM I right asking for a refund?

I bought a CD, described thus:
PLEASE NOTE THAT THIS CD IS IN MINT CONDITION. HOWEVER THERE IS SOILING TO THE ART WORK!!!
So I expected scribbling or some such on the inlay.
What I got was an inlay that has somehow been glued together so it can;t be opened, so I can't see the lyrics, and I am not happy.
I have emailed asking for either a swap of inlay (if he has another) or a refudn so I can buy it again off another seller.
When he said soiling I expected dirt, not for it to be totally unusable.
Do you agree or am I being unreasonable?
He's a power seller with 1500 feedback so I expected it to be OK.

I would have asked the seller to describe it in more detail, however, i would ask for a reduction in the cost, borrow it from the library and make a copy of the booklet

depends if you paid over the odds for it, as a seller to save hassle i would have sold it without the booklet, would you have bought it then ? Some people dont see it as part of the album, although it does seem ridiculus to include something that is totally unuseable.

Hi, I think perhaps you should have emailed the seller to find out the soiling! did you get this at a bargain price? can you print the lyrics off and ask for a partial refund? or if you are really not happy then ask them what they advise, I defo would have written in the description what was wrong with it and think the seller was a little bit naughty.

ideally you should have clarified exactly what the soiling was BEFORE bidding
but, ideally the seller should have clearly advertised what the problem was
6 of one and half a dozen of the other here,
in an ideal world the seller should offer some form of recompense,
you could file a 'not as described' against the seller BUT, he may say tough luck!, i know i certainly did when a person bought an item off me described as 'not working, sold as seen' in the biggest text possible, in red. they promptly complained upon receipt that it did not work!, I said 'yes, and???' they said 'i want refund' i said 'get lost, do you actually READ the auctions????'

No, I wouldn't have bought it without the inlay. I want the lyrics!
To me, soiled means dirty. Maybe I should have emailed, but stuck together is something else entirely, and I really wanted a copy of this album, as it's an old one from my youth.

I would email the seller if you are really not happy with it. See what they say.

I have emailed and will see. Im not precious about things like that but my brother in law had a massive collection of books, cds and dvds which im now selling and every one looks brand new. I, on the other hand, probably dont have a correct cd in the right case anywhere !
If you feel strongly about this trust yourself, if you opened it and thought :mad: then persue a complaint. As a seller its really up to him to give an accurate description, you can bet if it was a plus point he would have screamed it from the rooftops !! Thats what the negative is for, dont be afraid to give one incase you get one back, if hes done this even twice thats still two peoples money he shouldnt have got.
