Creditors refused payment offers-what now

Hi all, this hot humid weather seems to get everyone down and I'm no exception.
I sent my offers of payment to my 4 creditors with my cccs budget and all have refused because its too low. They all want me to ring them and are all trying to ring me I know by the numbers on the phone display, MBNA caught me the other night and I felt I had been through a wringer and made to feel like dirt on their shoes so don't want to call the other ones. They have seen my budget and explanation and I DO want to pay them back but cannot see my circumstances changing and I don't know what to do. If I write back to them what should I say, or should I call cccs, I don't like to bother them they are so busy.
 you are as you are, if you aren't as you ought to be.

Ooh pattiemay, knowjust how you feel,4 months on and my creditors still won't accept our low offers.Stick to your guns,if you can't pay more, they can't have more, they can keep asking, but they can't have it.Try not to worry they are only trying their luck and sometimes it works,if you stick to your offers and treat all creditors equally they will soon settle down.

If you're already with CCCS, just pass everything on to them. They're only ringing you cos they think that as you're just 1 individual then you'll cave in to their demands for more money. Stick this awkward early period out with CCCS & they usually will quieten down eventually.

    Hi

It doesn't sound like you are on a DMP, are you just sending token payments? I have been doing this, and several did not want to accept that I just could not afford to pay them. All I did was keep writing to them, saying they have all my info, a list of my creditors and my budget. I stated that it was not because I didn't want to pay, it was because I could not pay.

They have mostly come round now, and some have been put to DCA's (in house usually). This has been going on for me since march. I changed my home phone number so they can only contact me by mail. They didn't like that either, but they have come round.

Even Barclays have tailed off thier nastly letters since I wrote to them with a quote from the Sunday Mirror, regarding a woman who had committed suicide due to debt......

“When questioned yesterday about Lisa's death, Barclays Bank said: "We extend our sympathies to the family. Barclays always treat cases of financial difficulty with sensitivity and care and we would strongly urge anyone experiencing problems with their finances to contact us at the earliest possible opportunity." “ Sunday Mirror

They have been strangely quiet since then!!

MBNA are known to be difficult. If it going to be a continuous string of phone calls, call BT and change your number.

    Good luck

Hi, Legal and Trade have harrassed me so much that I contacted the office of fair trading and trading standards and they agreed that excessive phone calls (about 20 a day) was harrassment. Legal and Trade were cautioned and its not happened again. I was told by them that if you haven't paid you are automatically put onto the call list and as their staff are on commission its in their interests to "catch you".

Thanks all of you, it helps to know I'm not the only one in this situation. I actually said to MBNA 'wait a minute I'll just check my money plant' put phone down for a minute then said 'No - no money grown on it yet'. Why can't they get it through their thick heads, I told them I was advised to go bankrupt and if I did they would get nothing cos I have nothing. Surely a small payment is better than nothing. Imight try ringing cccs and see what they suggest.
    Thanks again.

Tee hee - loved that bit about the money plant - good for you! Incidentally if you were advised to go bankrupt - are you sure that wouldn't be a better option for you? Not to be taken lightly I know but it maybe the better choice - many people I know who have gone bankrupt say that their only regret is not doing it sooner! If not - stick to your offer and redirect them to CCCS.

Hi Babe chin up i had months of continuous calls from MBNA / VIRGIN/CREDIT CONTROL (all same company) i was getting about 2 calss aday from mbna aaaaaaaaa7 virgin then about 8 aday from dredit soloutions, now CCCS will advise you to stick to your guns, tell them to ring them(if you are on a DMP) or ask them to put it all in writing, advise them that the calls are harrassing and you are recording everytime they ring, advise you will contact OFT and if they continue they will be investigated by OFT
ANYWAY: about MBNA they will only except a reduced payment if no personnal insurance policy is running, they will only except a reduced payment as long as you are under your credit limit (be warned they will start slamming charges on you now), they will only except payments that will take up to 10 yrs max to pay off they will however to continue taking your payments and continue to make them regardless of teh amount if you fail a payment they will try and pursue court/ or if you are not paying a reasonable amount ie if your situation changes and you could pay more etc
but other than that maintain calm insist you will no longer discuss anything over the phone request it all in writing and you will reply with haste
good luck and hang in their their bark is worse than their bite xxxxxx
sorry spelling shocking im tired xx

Thanks for that! Just opened this mornings post and Lloyds TSB are issuing a default notice and passing to a solicitor no messing, and thats only after one offer of payment sent, they don't mess about do they.
Got to go to work now, although I feel like going back to bed and hiding under the duvet, got massive headache already.

Pattiemay - call CCCS. Thats what we're here for. It takes a little while for things to settle down and some creditors (MBNA for example) are a total pain in the a*se but it will get better.

Theres no point in you sitting worrying and getting stressed out when you can call CCCS and unload a bit.

Although it doesn't feel like it at present, Lloyds defaulting the account is a good thing. It doesn't mean they will start legal action and their policy is not to stop interest until the account is defulted and passed to their collections agency. That letter will probably be the first in a series of 4 and the fourth will be froma company called BLS. When you get that letter, CCCS will need to issue another payment proposal to them.
