OR asking more questions and saying he will inform my OH parents

Hi,
I though going BR was supposed to be easy and an end to the worry, well sadly for my OH it isnt! He had a meeting with OR 4 weeks ago and was in there for 3 and half hours then again he had to go today.
The OR is constantly quizzing him about where his money went in the last 5 years pre the bankruptcy.
My OH broke down today, the OR who cant be more than 25 at the most seemed indifferent to my OH upset. My OH has coperated fully with him and keeps saying the same things (he feels like a criminal being interrogated) and the OR kept tutting and sighing throughout the meeting.
The OR has said he wants to contact my OH parents to verify that when he lived at home he paid some kind of living expenses to his parents and paid towards food and bills.
My OH parents are elderly and they are totally unaware of the bankruptcy and he wants it to stay that way, he`s scared that if they find out it will make them ill.
Does the OR have the right to contact them and inform them of the bankruptcy.....surely my OH has some kind of rights under the data protection act?

We are both at our wits end with worry over this now and my OH is getting upset and depressed about it all.

    I cannot believe what I have just read, I had my meeting today, and it was totally unlike your OH.

    I honestly do no think that they should contact OH parents, as it is his debt and it is his problems, and so I would be screaming at them if they wanted to involve other people.

    Did you OR spend thousands and thousands before getting into debt etc?? The only thing I could think of why they would be asking is if he is a constant spender etc, then he might get into trouble again even after BR.

    I would phone the office his OR is at and ask to speak to the OR's supervisor and explain to them yourself what a state your OH is in and about his parents, and ask them to review the case and see if all this is REALLY neccessary.

    Oh hun, I am sending big hugs to you both, you have both been through alot lately and you do not need this to continue, and to get sick over.

    Ask for a review and speak to pip squeaks superior, they probably do not know how he reacts to people etc, so you might be doing them a favour by telling them how he speaks to your OH.

    Good luck hun, I hope you can call them tomorrow to get this sorted out

    I'm going to bump this as I'm sure that one of the more experianced will have a opinion on this. I would say though it may be time to ask for a higher up in the I/S to intervene.

  • I wouldnt mind knowing the answers to this as I dont want anyone finding out and the only person I am telling is my partner.

    Sorry Trolley, but when your OH put that he'd spent £28k gambling and most of his debts were cash withdrawls on credit cards he opened up a whole can of worms that the OR isn't going to let go of lightly, they're going to want to get to the bottom of exactly where all that cash went and asking his former 'landlords' how much he paid is part of the process, it's just unfortunate that it's his parents and not an independent landlord.

    This is not normal practice, but Trolleydolly's OH's BR isn't a normal case.

    Hi TD, like you I’m having a really hard time with my insolvency examiner. I’ve provided everything I possibly can but I’m being treated like a criminal when my bankruptcy was clear cut and awaiting for my soa to be looked at and my IPA set. If anyone has made it drag on it’s been the examiner. I can honestly say ive been polite in every correspondence but the demeanour in the letters I’ve received from the examiner have been to put it frankly disgusting, I’ve not asked anyone on here but I’m going to contact them and ask for another examiner to deal with my case as this person behaviour is appalling, he is based in a London office so if your oh is It could be the same person!! Hope you sort it out, just wanted you to know that you’re not the only one being treated like ****!

    Like Peachy price says they can ask anyone who has financial infomation about the bankrupt to provide information as long as it is reasonable. Since they are investigating how the money was used especially as you have mentioned gambling then it would seem reasonable to ask if he was paying the money he said he was. After all you would not object to them contacting you bank to check those payments.

    The problem seems to be that you were under the impression that bankruptcy would be easy, although your debts are taken away in short order it is not easy and your finances are being investigated

    sorry to be blunt but everybody seems to focus on the half of the job about the debts and assets and forgets about the half of the job that is investigating on behalf of the court.

  • Hi Amiga, this is Trolley`s other half and I was the one who went BR last July.
    After 7 months off being BR i also received a phone call from the OR regarding my file and i also panicked as after all this time i had tried to forget it all and move on. I was a nervous wreck for a week worrying and stressing about it as i guess your feeling now. I had my interview last week and it lasted 3 hours, but it was my own fault because i hadn't signed or done what he had told me to do in the letter , so that wasted an 1hr and half. I was worried right up to the time i went into the office , but whatever questions he asked just answer to your best knowledge for instance he had my bank and credit card statements for the last 5 years and any large amounts i had to tell him where it had gone ( bearing in mind i couldn't remember what happened last week never mind 5 years ago :rotfl:)
    Don`t worry about how long it takes the OR just wants to get all the answers so they can complete and close your BR file. From their point of view seeing you face to face gives them a better understanding of your personal circumstances and you as a person. My OR was understanding he never judged me and the whole experience wasn`t as bad as i expected. It was me worrying over nothing, so the only advice i`ll give you is have a good nights sleep and try not to worry and above all be as honest as you can with the OR and you`ll have nothing to worry about.

    I can't offer any pratical advice but just wanted to extend my best wishes to your OH. He was very decent when I was going through my wobble a fortnight ok, and I hope that things start looking brighter for him soon.
