Help!!! Advice please - Timpsons have lost my watch!

Hi all

Thanks in advance to anyone that can help me - it is appreciated. And, I hope I'm not coming across as trivial here, I know there are people with more to worry about than a lost watch but if anyone could help with advice, it would be really appreciated :)

I took my watch in to Timpsons to be repaired 4 weeks ago now - they said it will be sent away and they will ring me when it's ready to be collected. As of yesterday, I'd heard nothing, so I rang their head office who said they couldn't trace it but would call me back today.

On cue, this morning an area manager called to admit they have lost it. He said it isn't in the branch, it isn't in the workshop and he can't think where it would be. To be fair to him, he sounded apologetic and said he would send some forms out for compensation.

What I want to know is what I can expect? The watch is valued at £195 (and this has been noted on the receipt I have got) but it was also given to me by my nan just before she died and it is worth a lot more to me than £195. I know it will seem like I'm trying it on - I'm not - I am genuinely upset and the watch meant a lot to me. But, if I am entitled to more and I am entitled to push for more then I am going to do so, frankly. They lost it, not me - I know mistakes do happen, things go missing in today's busy world - but at the same time surely they need to handle it fairly?

    Your entitled to the replacement cost only. Sentimental value, hurt feelings etc will not be entertained by them (or indeed the court!)

    You should get an exact replacement of the watch from them (If they buy it for you then at least their loss is just the trade amount and the VAT). If the watch is no longer available then a cheque for £195.

    Your 'damages' are £195, so that is all you can claim for.

    Bear in mind that they are not bound to give you the new replacement cost of the watch, legally they would normally have to give you the value of it taking into account wear and tear. Although in the circumstances if you are handle the complaint in the right way eg keep your correspondence polite and especially if you get this area manager on your side there is a good chance you may be able to get the new replacement value perhaps even with an extra payment for the inconvenience.
