Credit Card company has not replied within 14 days. What do I do now?

Hi everyone

On 16th Feb 2010 I sent a letter to Barclaycard requesting that they repay credit card charges of around £250 as I was in financial Hardship (I provided them evidence of my hardship).

On the 24th Feb 2010 Barclaycard replied to me via letter and told me that they aim to resolve the matter by 17th March 2010.

Today it is the 17th and I have not received anything from them.

So I was wondering whether I can now claim my money back using the ‘judgment by default' method and how I can go about doing this.

    I am slightly confused here for a few reasons so will need to clarify a few things.
    1) Why are you claiming financial hardship on a credit card or is this a bank current account?
    2) Have you filed a claim using MoneyClaimOnLine because there is no judgement by default if there is no claim filed?
    3) The company have 8 weeks to respond prior to you being able to use the FOS, the letters on here are geared towards going to court ie making a legal claim for the money.

    No. Judgement by default only applies to court cases where no defence is offered ... and it's not automatic even then; it needs to be applied for.

    Refer to the post by NWSM above. You appear to have a number of misunderstandings over the reclaiming process.
