PPI reclaiming & already in a muddle!!!

Hi....I'd looked into PPi reclaiming on this site ... stupidly, I went wrong on the first step!!
RBS..Everything from Loan, credit card & mortgage was from our bank & I knew we'd always had PPI on loans so sent a letter to my branch on 17.1.10 asking for copies of loan agreements. (I have a lot of older paperwork but not from the most recent loans). I didn't keep a copy of the letter! I didn't send by recorded delivery & I didn't send any payment! (TWONK!) Anyway, I found other direct debits going out for god knows what & also started investigating them & sending letters out..
1 DD was to direct line. Discovered it was put on with RBS mortgage in 2000 (This mortgage was moved to C&G in 2002). I phoned a number I was given which was for PPI mis-selling RBS -Hardman Boulevard. Recieved a letter from them dated 19.1.10 ...looking into complaint.
Found out (instead of applying individually for C/C & loan info seperately) all info on RBS accounts could be obtained from Data Protection Officer in an address at Gogarburn, Edingburgh.
Sar letter was copied from here and sent RECORDED to this address along WITH cheque for £20 (joint name account) ..bought a printer and copied the letter this time!
So far I've recieved..2 letters from Manchester asking for more time..just phoned them to confirm WHICH PPi....Mortgage.
Nothing from bank yet regarding loans. (even though branch told me 1st letter had been passed to right department)
6 years worth of OH credit card statements...This is where I became confused.(have corresponded with them over a D/D not recognised...we'd thought it was to do with PPi..just more foul ups we've made.) This wasn't a response to D/D but response from SAR.
I REALLY needed telephone transcripts from them but they have asked for what dates I need...1998!! (whatever they've got from that year!) The letter says if I request what dates are needed, they'll send it.
Do I request this from C/C customer services in Southend-on-Sea or Data Protection Officer in Edingburgh and should I phone or ask in writing, keeping a copy & sending by recorded post?
Still not sure whats happening about copies for Loan Agreements, heard nothing from 1st letter OR from SAR...(SAR was done correctly & sent 17.2.10 so there's still time but want to be sure any & ALL phone transcripts with branch will be sent to avoid further delays as seems to be happening with mortgage & c/c)
Sorry for the long post, just driving me loopy and I haven't even submitted a single letter as yet claiming anything was mis-sold...No point until I can get all my paperwork in order. I'd prefer submitting the whole lot together as PPi on credit card was taken because of the information given with first loan. I hope this makes some sense..(to someone even if not me!!:rotfl:)

Just a quick reply here southernbelle.
If you ask for a copy of the original agreement send £1.oo cheque with your letter and they have 12 days to respond.
SAR letter they have 40 days to respond. Send 10.00 cheque recorded delivery. If they ask for more time then it is up to you whether you want to give them another week. If they do not reply then send another warning letter saying you will send complaint into the Information Commissioners Office. Ask them for exactly what you need I believe the SAR letter on the sticky here makes it quite clear.
When you write to state how you felt the PPI's were mis sold they have 8 weeks to reply. If they do not reply in that time. Write giving them another week and then pass on to FOS.
Am sure somebody else will come on to answer your other points.
Good Luck to you.:mad:0 -
thanks maxdp, the SAR letter you mentioned is the one I copied from here and sent in February. I have just phoned the C/C about the phone transcipts and she has just informed me that any phone records they have there would only go back 3 months. I did send a payment of £20 to cover the cost and don't mind waiting, gives me more time to organise my end, was just worried that I've heard nothing regarding loan agreements.
I haven't been able to get a phone number for the address the SAR was sent to....If I can get a number, I could call to check ALL phone transcripts will be sent AND be sure they are dealing with loan agreements.
I've got myself in a muddle with who is dealing with what complaint or query is all....I'll hopefully get to grips with it eventually!
Thanks for your help. SBPROUD MEMBER OF

Hi Southern Belle
I know it can get very confusing. I am surprised that the phone records only go back 3 months. If you cannot get the phone number then send another letter asking for All transcripts etc. It is best to communicate by letter since they only keep phone records for three months. LOL
Try to keep every complaint as separate and keep it in a separate file. Not meaning to lecture just know it can get confusing with multiple complaints. LOL:mad:0 -
Taking what maxdp has said it may also be a good idea to have separate threads for each PPI complaint again so as not to confuse or get mixed messages.

Thanks guys! tried to respond before but having computer/net problems.
I have got my RBS paperwork together now (older than 6 yrs) so just need the more recent info which should HOPEFULLY all be included under the one SAR. (I did originally think I'd have to make 1 request to Ccard & another request to the bank so this should have been easier!
I got confused because they're responding individually but still had nothing back regarding loan agreements with the bank.
Does seem odd that Cc claims only 3 mths records of phone calls so I'm hoping the Data Protection Officer for RBS in Edingburgh might send more recordings.
Would be interested in what you think as transcripts will help with the claim, both credit card and some of the loans originated with these calls. Do you think they might store the CC calls over 3 months there?
Should I wait the 40 days or send another letter JUST for the call transcripts?
(Your SAR does already ask for it so ..?)
Anyway, on a brighter note, found lots of discrepensies and have cancelled DD's that weren't needed (even had over £500 refund from one of them).
FINALLY managed to cancel a DD placed on OH CCard...pig of a job but done!
Discovered that C/tax band might be too high. VOA are looking into it & if all goes well, possibility of 13yrs refund on overpaid amounts.
Discovered PPi added to car finance & have written to them about it
Amazed at how trusting we've been with our bank (and foolish!) but you've opened our eyes and we now know where to look to find the truth!
Oh, also found out that while we were over insured on lots of things, we had a massive hole in life assurance on our mortgage which has now been dealt with. This could have been a major problem and it's a relief to know its sorted.
I'm new to computers too but watch Martin on GMTV. Wanted to reduce some of our utility bills but never imagined how much information & help I've found on here. Thanks to all of you.PROUD MEMBER OF

Okay, the postman's just been!
Almost 1 month after the SAR was first sent along with a cheque for £20 (joint name account).
Pleased that SAR has been acknowledged from the Edingburgh address but they've returned the cheque!!! :rotfl:(even with the step by step guide I'm still getting it wrong!)
They only charge £10 for the information I've requested so please will I send another cheque for £10 back to them. (are they being helpful or are they stalling???)
Anyway, I better send it by recorded delivery but wondered if I should do another letter asking about phone transcripts from the C/C account (older than 3 months)
Di...sorry for the hand holding (you've helped me on PPi already):o
Any suggestions?PROUD MEMBER OF

We are all fingers & thumbs to start off with! As has been mentioned they have 8 weeks to respond to the SAR & if anything they could have sent your cheque back closer to the 8 week deadline so, it seems to me if anything they are being quite helpful. Send back a cheque for £10 by recorded delivery, with regards to the phone transcripts imo it may be worth while waiting to see what information you do receive ( You maybe surprised ) from the SAR, if they are not included then follow up with another letter stating ( Can be found in the Templates Library ) that the SAR was not complete, sort yourselves out or i will report you to the relevant regulator.

Hi hun
Not a problem lol

That saved you a tenner then as they only required the one £10 for the info combined and not as 2 joint holders. I think that is fine then.
Yes I always think its a good idea to request for the copies of the phone calls, so do write and ask if they could kindly send by 14 days.;) My phone calls with one of mine was sent free, so it may be worth finding out if they do this free or not, the SAR you requested they should have also enclosed copies of written transcripts within the pack, well I thought they would have, as this was already requested for on the SAR letter. The one and only "Dizzy Di"

Thanks di ... and Mangle...and max.... you've been great!
The phone transcripts bit did surprise me..I think I will query the CC's claim of only keeping 3 mths when I send the cheque back and ask them if they store the older recordings...just in case
Mangle..I had to re-read your last post. I freaked at first and thought for a minute that you were going to report ME to MSE unless I sorted myself out!!:rotfl:
Thanks for your patience guys...up till now, we'd only ever listened to what the bank advised...that turned out well!!:o boy do we feel like suckers!
Glad you're all here!...Ooooh and £10 saved already!...Yippeee:)PROUD MEMBER OF
