Item hasnt come??

Hi there,

i brought a light off the internet for £90 on 6th feb. i got a email saying it will come between 2-4 weeks. the item didnt come and hasnt as yet. i have email 3 times n got no answer the phone is 24/7 engaged. i asked a customer question off there site with a differant email address asking if the item is in stock they said no not for 4-6 weeks. they havnt told me this. what should i do. i paid with a solo card.
it a english company so they say with a address in durham.

    What do you want to do?
    If you want a refund it shouldn't be a problem because its not reasonable to expect you to wait another 4-6 weeks.
  • Well i want my money or the item but they dnt reply to emails and the phone dosnt work? so not sure what i can do to sort it

    Send a letter by recorded delivery so you can be sure it got there, tell them that you want either the light or a refund within 14 days. Failure to do so means you will persue the refund via the small claims court and they will be liable for additional costs. It costs £30 to file in the small claims court: https://www.moneyclaim.gov.uk/csmco2/index.jsp

    If they do not get/collect the letter go back to your bank and file for a chargeback as it was a fraudulent transaction.

  • spooky, i just got a email from them, saying it will be 21days due to a proplem not in there control. i dnt want to wait this long am i in my right to ask for the money back and what should i say thanks

    Yes, just omit the bit about them sending the goods, just tell them that you want a refund as you did not want to wait this long for the item and you would like a refund within 14 days or.... (as above).
